I. Opening Statement

Honorable Supreme Court, on the 13th of August 2022, I, Jerry Swindle, was found guilty of 2 charges, 1 of Impersonation, and another for Perjury, by Sir Klaus, from the AAT Committee [Reference A], and am coming to the Supreme Court of Vice City to appeal parts of the decision/s.



II. Explanation

I would like to make it clear to Sir Klaus, or whichever Supreme court panel gets handed this appeal, that I see now that what I should not have done what I have done. I should not have attempted to represent the state in criminal court. I was led to believe that my actions were just and lawful, which can be seen by my initial response to the claims by Special Agent Kowalski, in which I confidently answered that I was allowed to represent the state.
Now, obviously I am aware that I can not represent the state, but would want to bring it up that my actions on that case were 100% out of good intentions to the people of Vice City. Good intentions, but unfortunately, bad results.

I am aware that breaking the law is breaking the law, and people found doing so must be reprimanded, and my case in this appeal is to prove that my intentions were good, and to at the very least have my fines lowered.
I have brought together several current members, and past members of the VCPD, and (once I get their messages), some of Vice City's civilians, who have got to work with me, and see my work first-hand, to give to the court a character testimony, regarding who I am, so that it is apparent that my intentions, as I said, were nothing but good, and had not an ounce of malice.

Although even 1000 goods don't fix 1 bad, I would like to tell you that the officer in question has shown multiple times on multiple occasions to be a great teammate in the field and has saved my life multiple times.

I also would like to add that there have been a couple moments where I doubted this officer's righteousness, but I have never collected any direct evidence of this, therefore I would consider him innocent until proven guilty.

I hope the fees can be looked at once again as I strongly believe this man did not mean to cause defamation regarding Law Enforcement nor attempted to earn money through the State.

It is noted that VCPD has seen different stages and situations. Sometimes it outplays the criminals exceptionally that they don't even show up for months and sometimes its performance is disappointingly down due to the inactivity of the department but in this period of tough time, there were least people who stayed to support. One of those was an officer from Patrol Invest Group named Jerry Swindle. His supreme presence in our tough time has helped us maintain our firm position. We are glad to have such an officer in the Argonath Police Department. That is the reason I, VCPD Officer Hazard is writing a recommendation letter about PIG Jerry Swindle.

Mister Jerry Swindle is a man who means no harm and is always going out of their way to help and ensure the safety of the common man (us civilians). Our encounter is still so fresh in my memory, due to how Mister Jerry handled the situation, honestly, if we had more men like Mister Jerry in the Police Department, I’d go to sleep with my front door unlocked each night!

I was passing by Vice Point when a reckless driver almost bumped me and a couple of other civilians. Mister Jerry was nearby. His instinct was to check up on us first and make sure we’re doing okay and then proceed to take some sort of action against the guy. That is when I asked for his name and this brief encounter got imprinted in my memory forever.


I would like to conclude by saying that actions speak louder than words. And that Mister Jerry’s humble action against the civilians should be sufficient to last an impression on everybody involved in the matter.

As I hope the supreme court can see, I possess a portfolio of service as a police officer, which can be seen by the people on the field as positive. My only goal is to protect Vice City and it's people to the best of my ability.
And part of my efforts to help the people of the city, require some capital, be it vehicle repairs (because I often use my personal vehicles for police work), weaponry (because I often purchase guns to use against criminals), and more.
The fine I got for $70,000 ARD has definitely made an impact in my bank account, and made it harder for me to invest my capital into the city and it's people.

My humble request to the supreme court of law, is to reconsider the ruling given by Sir Klaus, hopefully lowering the hefty fine handed to me due to a mistake I made.

• The supreme court to reconsider the fines and/or verdict given to Jerry Swindle on the 13th of August, 2022.

Greetings to the courts.

The United States requests the courts to suspend this appeal due to an ongoing prosecution against Mr. Jerry Swindle in the court case United States of Argonath vs. Patrol Invest Group. (https://www.argonathrpg.eu/index.php?topic=130002.msg2010851;topicseen#new) Given the ongoing prosecution of Mr. Swindle for a number of serious offences, these are in direct contradiction to the character references posted by Mr. Swindle and the claims of being a diligent police officer.

As such, the United States requests that the courts suspend this appeal until the conclusion of the prosecution against the Patrol Invest Group given the charges against the defendant, Mr. Jerry Swindle.

Statement of the Vice City Police Department


To begin with, please let me ask the honorable judge(s) to invalidate the statements quoted due to the reason of false representation.
The offical stance of the Vice City Police Department is that Patrol Invest Group, whose alleged leader is Mr. Swindle,  and who currently has an active prosecution case on-going for a multitude of serious charges, is an illegitimate organisation who masquaraded as the police force.

The reason these statements should be considered invalid is because they are signed by persons who have signed said statements using their VCPD ranks and insignia, and in some cases even using the VCPD logo, implying this is the official stance of the VCPD. The description of these statements presented by Mr. Swindle seems to further reinforce this notion. I must emphasize that this is not the official stance of the VCPD, as said above.

While these officers certainly have the right to express their own personal opinions, they should do so without affiliating themselves as members of the department, creating a false impression that this is the stance of the police department. For this reason, I'd like the above statements to be invalidated, and the officers involved can post their own statements without affiliating themselves as members of the Vice City Police Department, and without using their VCPD positions as signatures.

The officers involved were since provided disciplinary talks on why they should not be liberally putting their signatures on something like this and why it affects the VCPD.

The VCPD's official position is in complete unison on this situation with the FBI.

((OOC: Dani, you are literally throwing a tantrum for Kowalski thinking he "owns the courts" when he lawfully and with a valid reason posts his objection, and so do I, as it involves an on-going case. Given the roleplay circumstances involved, he has all the rights to do so. Your troll PD RP was a nuisance to anyone who ever took the PD role seriously, and you should be naive to expect we wont get involved in your attempt to chicken your way out of the RP consequences of it. ))

Objection!
Honorable Supreme Court, the testimonies must not be invalidated to these reasons, because the inclusion in the appeal of the witness' ranks, is to provide proof of relevant backgrounds and that the witnesses are competent to provide testimony on my (Jerry Swindle's) work and character shown in the field.
