Title: Copban Request
Post by: kevman2000 on December 28, 2010, 01:46:38 am
I have a problem that I would like to be brought to everyone's attention.  I believe [SAN]Taylor_Fox should be copbanned for his/her actions today.  As seen in the logs below, after being suspected (for no reason, nonetheless), I requested an investigation.  After entering the police station, we never really initiated the investigation.  However, she eventually read me my miranda rights, and asked me if I understood.  I said I refuse to answer her until I get my attorney.  As you can see, she then threw me in jail for 180 seconds.  I'm requesting a copban on her, and a fine for at least the 1.5k she made on the transaction and a reimbursement of 200 dollars on my part.  Also if an admin wants to confirm, it was at 1:26 AM on December 28, 2010 (ARGONATH TIME) in Mordor Prison

If this is in the wrong section, can an admin please move this.

Thank you for your time.

[19:26:02] [SAN]Taylor_Fox(61) says: do you understand the rights i told you

[19:26:04] [SAN]Taylor_Fox(61) says: YES or NO

[19:26:06] [SAN]Taylor_Fox(61) reads the miranda rights out:

[19:26:06] You have the right to remain silent. Anything you say can and will be used against you in a court of law.

[19:26:06] You have the right to have an attorney present during questioning. If you cannot afford an attorney,

[19:26:06] one will be appointed for you. Do you understand these rights?

[19:26:14] <[NP]Curse[CG]> (56) Ok so half way across map for $100 :(

[19:26:17] [ACB]Mario_maninghio(47) says: im not saying anything until i see my lawyer

[19:26:23] ADVERTISEMENT: FreeCop SWAT is hiring members, get on TeamSpeak to join, contact [SAN]Mike_Hawk[AF](Phone:292445)

[19:26:25] <ConstructionZombie> (62) i wouldve

[19:26:25] [SAN]Taylor_Fox(61) says: ok then

[19:26:30] You can still be taken to court for your crime, if its serious enough...

[19:26:30] You have been jailed by [SAN]Taylor_Fox(61) for 180 seconds, relax

[19:26:30] Weapons removed during imprisonment.

If Taylor is a SAPD Officer, report him at the arpd website. If a freecop, nothing can be done with the copban, else send an email to [email protected].
And I'm sure this would make a good court case.

He is a free cop.  Should I just repost this in the court section?  If so, which court would it go under (economic, criminal, etc.)?

Thanks for your help.

Where is it written that you cannot be jailed before investigation / court case?

Just because you demand a lawyer / investigation, it does not mean you cannot be jailed.

I asked for an investigation and a lawyer for my case.  Thus I can't be thrown in jail without getting a proper investigation.  HE READ THE MIRANDA RIGHTS TO ME!  He just went against what he had just said!

This isn't the place to post your complaints. Go to ARPD Forums or [email protected] for that.

See Session 6.
SAPD Cadets must learn this before they can become an officer, and these rules still stand for the ARPD Officers.
If somebody requests an investigation, they must be given one, and they have the right to remain silent. They do not have to say anything until their lawyer gets there, and this must be done before the /jail process.
All citizens of Argonath have the right to a fair trial before being deemed guilty, thus the phrase innocent until proven guilty.

>rules which aren't even accessible for someone that is not in SAPD-ARPD
>stand for freecops

You cannot demand to not put you in jail if you are a suspect - else everyone will just demand a lawyer and not go to jail, stalling cops and ruining the fun of the game, because it's no fun to sit in a PD and wait for some lawyer arrive, just to start arguing if someone is really guilty or not.

Even if you are innocent but refuse going to the cell while demanding a lawyer, you're committing the crime of resisting arrest and become a valid criminal anyway.

Every player has the right to an investigation before being jailed, its in the Consititution post on the ARPD forums.

I'm not resisting arrest if I surrendered and followed the cop to the police station.

If you look at when you get jailed, it says you can still be prosecuted by cops.

BTW, thanks for showing those logs, Mike impostor Freecop SWAT. Now I have proof.

I hate to be rude, however you don't know the circumstances of this situation.  I was inside the police department having an investigation conducted.  Thus I followed the cop and was not resisting arrest.  Also, in real life, one doesn't get jailed for a full sentence before investigation.  This is a commonly known fact.  I'd truly appreciate it if you would stop commenting on this if you don't look at the facts and offer insight.  I know you are trying to defend Taylor, however please use relevant information.
