Title: North Point Mall Ammu-Nation vs VCS
Post by: Marcell on April 24, 2012, 04:02:22 pm
Hello, this is Marcell Kuklinsky, I'm representing NPM Ammu-Nation store and I would like to sue Mr. VCS.

18:00 CET time, 21/04/2012, Mr. VCS has bought two guns using future investment option. Those guns were China Lake grenade launcher, and a Thompson M1928 SMG.

He agreed to pay 1,200$ for the Thompson SMG back in two days, as well as 1,950$ for the China Lake grenade launcher. He has also said that if he doesn't pay back we have the right to force-deduct cash from his bank account, and take his retirement money.

That being said, I demand:
-1,200$ for Thompson SMG
-1,950$ for China Lake grenade launcher
-2,000$ for detective salary I had to hire to find him (we discovered he left the city few hours after the purchase, and hasn't came back since then)
-5,000$ since he said we are able to take his retirement funds if he doesn't pay back
-500$ as court fees.
-Since during the transaction client has agreed to let us 'ban his account', after deducting the money needed to pay off our 'damages', please reset his bank account status to zero.

Evidence: (coming from a camera in my store, the sound quality is perfect)

The Court of Vice City is currently processing this case and reviewing the evidence submitted by the plaintiff.

From the evidence ('contract') presented here, it can be confirmed that a mutual agreement was made between Mr M. Kuklinsky and Mr VCS. As a registered business, the Ammu-Nation (North Point Mall) will receive certain degrees of legal/court protection.

Although the above products are not listed in the store's available inventory - as displayed here (http://www.argonathrpg.eu/forum/index.php?topic=83608.0) - we take it as being valid, and under the terms of the contract, VCS owes a total of $3, 150, which is now overdue by 1 day + (contract: 21/04/2012 - 23/04/2012, similar times).

-1,200$ for Thompson SMG
-1,950$ for China Lake grenade launcher
Combined cost of $3, 150 seems valid at this stage.

Quote
-2,000$ for detective salary I had to hire to find him (we discovered he left the city few hours after the purchase, and hasn't came back since then)
Would you have any additional information on this?

Quote
-5,000$ since he said we are able to take his retirement funds if he doesn't pay back

As far as we know, this was not part of the 'contract' itself, but something slipped in by the client afterwards, as shown in the evidence submitted. At this stage we cannot be sure on such monetary values in any case.

Quote
-500$ as court fees.

The court itself in most cases operates as a free service.

No interest rates on late payments are apparent in the contact, or have been suggested to this court.
Any payments made would include damages to either party.

Before we advance this case further, the Court of Vice City would like a statement from VCS and any representatives regarding the details put forward by the plaintiff.

Yes the cost is valid.
I do not possess additional info about detective service, sorry.
I admit I went too far with describing the amount of cash which shall be taken from his account regarding retirement funds, in that case I would like government investigator/banker to check client's retirement funds and transfer it to our bank account if VCS fails to pay us back.
Sure, no need to pay court fee then.

Signed,
Marcell Kuklinsky

Thank you for the details.

To aid in this case, I don't think that client has been "in the city" (or so to say) since a little after the agreement itself:

True, I was present at the time, as I have strong connections with the store. I can say that the audio files are defiantly legit and my guess is that VCS probably thought Marcell would just forget about the agreement over time and obtain the guns free of charge.

VCS has been asked to check here.

We are currently waiting on the defendant's side.

1. There are some errors above report.(So i am here to show you some of the errors.)

Errors that you never checked.(This is where i can take the judicial department, and the NPM Ammu-nation store to task.)

1. Yes i asked for the following guns(But never received that following guns as followed.) As i have seen the weps list for North Point Mall Ammu-nation the Thompson SMG never existed, And so does the China Lake grenade launcher(Also known as the Thumper grenade launcher that was used in the 1980's Vietnam war with the Americans). And besides the judge is taking sides for Mr. Marcell. Becuse even the guns never existed in the NPM Ammu-nation inventry. Also as Legend said

2. You cannot deduct more money/cash just for a person that might exist/may not exist. If there was such a detective and you had hired him. it should only come out of your own salary. Because it was your own Private Detective that you hired. This could have being done by yourself.

3. You cannot take my(Mr. VCS) retirement cash out as it only can only be done if the defendant(Me, Mr. VCS) has married to a legal wife or spouse. As stated in the law.

4. If you are going to sue me, You have to pay the $500 fee because you are the one that started to sue me.

5. You cannot take my cash or ban my account. Because I had never received the Thumper and the Thompson SMG.

6. All this is all roleplay acting. And i was roleplaying. If you wanna go through a kind of fake sue i will take Mr. Marcell to supreme court(high court). And i will take the judge for taking sides and Mr. Marcell for falsely sueing me.

Thank you to defence.

First of all, if you are prepared to issue threats against the judicial body, I would strongly ask you to consider otherwise.

I would like to remind you that you were the one that we have been waiting for.

Both yourself, Mr VCS, and Mr Kuklinsky (representing the Ammu-Nation (North Point Mall)) are the signees of the contract.
You are shown agreeing to purchase those products, as Mr Kuklinsky is agreeing to sell them to you with due payment.

The contact - under the above terms - is valid.

Side point:

Everything within this legal system, alike things in the server, are done with certain roleplay bounds.

Your "statement from law" would not be taken into direct consideration within these walls.

As noted, the Court of Vice City has not made a final verdict yet.
If any damage cost(s) are relevant, they would be accounted for.

Also, a bonus note - it doesn't matter the weapons weren't in public inventory list, since they are classified to be 'exotic imports'

EXOTIC IMPORTS
Due to our connections, for wealthy clients we are able to import any gun into the city, with exception of aircraft machine guns (Volcan Minigun, and such).

the reason why I had the particular armaments (which VCS requested) on sale, is because earlier that day, EAF enterprises has moved a shipment into my store which was bought off San Andreas contacts. (http://i45.servimg.com/u/f45/17/45/72/99/vc-mp-16.jpg)

The Court of Vice City has come to a ruling, based on the details submitted here from the two parties involved.

The agreement between Marcell Kuklinsky (Ammu-Nation (North Point Mall)) [plaintiff] and VCS [defendant] remains valid, within the terms set by the two. As the evidence shows, the exchange of products between the Ammu-Nation and the customer, Mr. VCS did take place after/through mutual agreement in April 2012.

The Court of Vice City would like to reinforce its previous statements, and hereby order VCS to make a payment of AD $3, 150 immediately to Marcell Kuklinsky (rep. Ammu-Nation (North Point Mall)).
The central bank is to oversee this transaction and is permitted to carry it out if needs must.

A confirmation could be helpful.

lol, even if it was it doesn't matter cause the case is closed either way - VCS, wire me the cash, if I don't see a huge announce 'VCS has wired you 3,150$' when I'm back, expect that I will report the payment was not made and it will be removed forcefully from your account. Thanks.
