Euthanasia (ASSISTED SUICIDE)

Honored Supreme Court & Presiding Judges,

I Mr Monte Montague am here today to challenge the implementation of an upcoming law that I believe is in direct conflict with the Constitution.

The Constitution of Liberty City states:
Ordinance X:
Everyone has the right to life, liberty and safety of their person. A person cannot be deprived of those rights except in accordance with the principles of fundamental justice or the interests of national security.


This bit about the constitution is very clear that the right to life can not be deprived except in the accordance of maintaining the rule of law and it would be taken that the only "lawful" killing (the loss of life is always regrettable and avoided always) would be if in the case of a law enforcer or security personal pulling the trigger on someone who is committing a serious dangerous crime or who could go on to commit crime, and as a result of disabling a person who has a criminal or terroristic plan could die - in such case and in only such a case would the constitution consider that a death is carried out "legally" if you can call it that.

 "The ultimate defense is the defense of another".

Euthanasia & Constitutional Law

Euthanasia is not in the interest of fundamental justice or national security or something to uphold the rule of law or anything of the sort.
 
As such anyone who is assisting the death of someone even if requested is committing an an unconstitutional act and thus a crime: by depriving them of their right to life.
A person them-self can not deprive themselves or others of their lives in any situation other than in the interest of where it may be required to save others.

This Constitution is very clear regarding the law on the subject of the right.
The Constitution does not cover the right to death which would be a suitable amendment in my opinion.

 As such it would seem no proper reservations have been made regarding this upcoming subject (it can be assumed that it is not a law as it conflicts with the Constitution) and it would be an affront to justice to actually allow this new law to go ahead without making actual provisions.

The upcoming law states:
"Act 2.4  No person is entitled to give death to another person without due process of justice, or unless a  person is requesting an euthanasia from a medic.  Exception is made for LEOs preventing or stopping a crime".

This law is extremely controversial subject, Euthanasia (assisted suicide) always is, regardless of the State you live in & from states around the world that have included Euthanasia or the Right to Death have made provisions for it, I feel there should be absolutely no less than examples used from those states - that is if the Argonath RPG State of Liberty City is to allow assisted suicide or assisted dying (Euthanasia).

Simply requesting "an euthanasia" from a medic is not ENOUGH to make such death legal.
It also puts the medic who may not want to or may not be comfortable with putting someone to death at risk of corruption in the course of their duties, or as a uniformed service person & even Manslaughter or Murder if they did go ahead with it due to family members who were not informed and as such would sue or seek prosecution for that act being carried out.

I can go on to make MANY examples of where I feel this legalized Euthanasia would be abused to commit MURDER or whereby without the lack of appropriate regulations on this subject would result in serious malpractice, concern and would actually be against the rule of law.

Personally I do not condone the act of Euthanasia. I believe that none has choice in entering the world and as such they should also not have a choice in the way they die. The choice of death or right to death is phenomena; it exists not!

It however also does not equate to a person recognizing that in their work or actions they could die (this is not the same as requesting euthanasia).

As a practicing Medical Doctor in the state of San Andreas who has from time worked in Liberty City I would not at all issue Euthanasia (I didn't join the profession to kill people) and as such I would argue that another medical professional would not accept the right of someone to kill themselves, I would not provide them the tools or any sort of assistance.

Medics can not be forced to provide this what is not a service & none would be forced (there would be anarchy and total disregard for rule of law if you attempted to force someone to kill someone against the will - which is a crime in itself - encouraging crime).

Killing a person, even if it is an officer saving many other lives by killing one person who is a threat to those many lives is not a nice thing, it can lead many years of traumatic experience, remorse, regret.

In healthy humans it is a natural observance to feel remorse for the death of others or death in general. Some fear death. Some do not. However the right to kill yourself would legitimize acts of suicide and likely suicide cults and such and such.

There are many cases where people feel they wish to die and the reality of the situation is that when you die; you die. THERE IS NO COMING BACK.

There are many people who go on from wanting to kill themselves to wanting to live every moment and every hour until the last.

Assisted suicide is a criminal act. It can not work unless many great procedures and regulations and measures are brought in. The argument (which I reject entirely) of those who claim to want or cherish the right to death is that "it gives them control", "the pain is too unbearable" (you could probably carry out medical procedures to improve symptoms for free than to offer DEATH as a first line treatment which this law would allow).

It would set a dangerous precedent for the Supreme Court to accept this law in the way it is currently written. IF Euthanasia is allowed then it should follow strict protocols.

I feel I have made myself clear on voicing my concern to this new & upcoming law and that the dangers to the rule of law and pursuit of justice that it presents.

Does the expat citizen of Liberty State, former LTA Director, who serves the Judge SA District Court, admiral of decommissioned Coast Guard still want to pursue this case?
