So due to the ongoing case with Nvidia, don't know how this is working but if you purchased a 970 via Amazon like myself, you are eligible for a 20 percent discount, seen a few results and going to test this out myself, but worth a shot eh?

Another source said owners can get 30$ refund. However it is not known if it applies outside the US, as the lawsuits were handled in California.

I can not find any official source regarding the Amazon refund.

EDIT: Apparently it's Amazon's and Newegg's own decision to refund 20 percent of the price and has been around since February 2015.

Well thats a good idea, but what I thought of doing is just refunding and going from GTX970 to 1070, but haven't got the box's it was nearly a year and half ago I got this.

Always keep the boxes of your hardware components. Even when selling them used, having the box alone makes it easier to sell/allows you to have a higher price.

It's good to have them indeed, sadly not everyone has the room/space to keep them. Selling makes shipping easier, price isn't usually affected it.

I got a Strix GTX 970 (Asus) and it should be too 3,5 + 0,5 GB Vram (4GB total Vram) .
I have tested it with Manu games as GTA V all ultra until it was using Vram between 1-4080MB it was working fine (in OC) so there was not any flooding of performance using over 3,5 GB. I don't really know well what should this 3,5 +0,5 GB issue however for me it works fine.
Btw soon I'll sell my GTX 970 to get a 1060 , if you want to buy it contact me xD.

Honestly I don't recommend upgrading from a 970 to a 1060. It's not a big jump - OC the 970 a good bit and if you're lucky it keeps up with a stock GTX 980. Keep it for a while until you can afford at least a 1070.

Same! never had problems of Vram.
I maybe will upgrade my GTX970 not soon, i didnt mean to change it when the 1060 came out for the previous answers.
