Greetings to the Federal Bureau of Investigation and the Argonath Federal Court,

I, Kowalski Kolta, will be representing Adrian "Parfait" Shepherd in this case.

To begin with, I will present one of Mr. Shepherd's previous statements to the court.

I,Adrian Shephard, hereby to pled guilty to all of the charges against me but I see it unfair as I have to pay a big amount of money just for only owning one kind of an illegal weapon, I request the court to decrease the amount of cash needed to pay, also I do not have the required amount of money, I only have a manana and a sanchez bike and the court can take them in order to get the fine paid.

My client regrets committing crimes of such atrocity.

My client was in possession of 450 units of Desert Eagle, which is illegal according to the Criminal Ordinance by the Honourable Judge Alexander Treblin. My client pleads guilty to this charge.

Charge #2 is for smuggling goods inside and outside Vice City. My client pleads guilty to this charge as well.

However, as my client has cooperated with his guilty plea, shown total remorse for his actions and even offered assets to the court which they can confiscate as punishment for his actions, my client requests that the fine and jail time is reduced.

I will present another statement by my client.

Dear Judge;
This is the first time I face a court case against me, yet I see it unfair to be demanded a fine of about 450,000 ARD for taking part in one illegal act and storing its reward, while I saw other defendants in other cases, who made terrible things and caused the loss of many lives of animals or human, that were only fined amount of money that doesn't overcome 200,000 ARD
In addition to that, as I mentioned above this is the first time I make an illegal act hence I learnt my lessons and regret of my acts and what proves that is that how I changed and became a lawful cititzen and sometimes I volunteer to help cops at doing their jobs so peace can reign in streets.
so I request judges to lower my fine as well as my jail time and due to my poor english and limited understanding of how court system work, I hereby want to hire a lawyer to defend me, but I didn't find any one to do that job so if it is possible I request the court to hire a lawyer for me and I will pay for him.

I will now, as an example, quote the jail time demanded against Goura Slasto in case "United States of Argonath vs. The Slasto Family.

"The state also demands that people who have been cooperating with the mentioned group to be issued the following prison sentencing:

2) Goura Slasto - several counts of vehicle smuggling, one count of armed assault and three counts of illegal posession. We demand 25 years (25 minutes) of imprisonment"

This man, Goura Slasto, truly deserves punishment, even more than he's already recieving, as he is nothing but a hardened criminal with no respect for the law, which I witnessed, being an informant of the FBI inside the Slasto Family.

However, my client is not a bad person, and his crimes are not as atrocious as Goura Slasto's, and on top of that, he has attended his case to show that he's a true citizen who made mistakes but wishes to recover from them.

Mr. Shepherd isn't asking a free pass. He just wants another chance in society to prove to everyone that he can change, which I truly believe is also an inspiration for criminals who wish to turn themselves around.

My client has offered his two vehicles, a Sanchez dirt bike, and a Manana. He is willing to give them as punishment.

My client is regretful and remorseful for his acts, and he understands how he could cause harm. However, he's shown a will to change, to turn around and become a true citizen. He is willing to accept whatever verdict the Argonath Federal Court delivers, however, he wishes that his jail time is decreased to 12 years (12 minutes).

On financial terms, my client wishes that his vehicle(s) are liquidized and their value is issued as the fine.

JUDGEMENT

[1].        By criminal summons and indictment filed on the 18th of June 2018, five defendants: Mr Franco Carruzzo/Franco_Leone/Lorenzo_Leone (the ‘First Defendant’), Mr Thomas Ricci/Tom_Anderson/Tom_Leone, (the ‘Second Defendant’), Mr William Leone/Elio Sinagra (the ‘Third Defendant’), Mr Adrian "Parfait" Leone (the ‘Fourth Defendant’), and Mr Salvatore Fausto/Savitar_Leone (the ‘Fifth Defendant’) are charged with various charges. I will discuss the evidence in relation to each defendant and then go over their submissions.

Franco Carruzzo/Franco_Leone/Lorenzo_Leone

[2].        The First Defendant is charged of organising a criminal entity. The evidence given by the prosecution proves this beyond reasonable doubt. In Exhibit 1 the defendant establishes that the Leone are a Family and speaks of it's many members. He confirms that the other defendants (Second, Third, Fourth, and Fifth) in are entities of the Leone family.

[3].        Exhibit 2 submitted by the prosecution, establishes that Private Property #84 Downtown Skyscraper is the headquarters for the Leone Family's organisation. This is first confirmed by the First Defendant in a voice recording, and later backed up by evidence of multiple family members collectively using the property along with another voice recording of the First Defendant telling the other defendants to use the property and it's weapons, such as an M14 rifle. 

[4].        In Exhibit 8, the Fifth Defendant is arrested and interrogated by the FBI. During the interrogation, the Fifth Defendant establishes himself as a "Soldier" for Leone. This is a commonly known term used by Criminal Organisations. He later confirms that the First Defendant is the leader of the Leone Family. Due to the Fifth Defendants position within the organisation, we find this statement substantial.

[5].        In Exhibit 3, the First Defendant is caught illegally smuggling contraband into Vice City. As the Leader of the Leone Family, the First Defendant has organised smuggling operations using it's members as "soldiers".

[6].        In Exhibit 9, the First Defendant is recorded illegally smuggling contraband into Vice City. In the recording, he is seen taking a crate of diamonds and then selling them to the black market. He then deposits this dirty money into his bank account.

[7].        The First Defendant submitted a plea of Guilty to all charges put forward by the Prosecution.

Thomas Ricci/Tom_Anderson/Tom_Leone

[8].        The Second Defendant is mentioned to be a member of the Leone Family. Evidence submitted by the prosecution in Exhibit 1 proves this, and we find the statement substantial due to the First Defendants position within the Organisation.

[9].        In Exhibit 5, the Second Defendant is seen smuggling automobiles in Vice Port. We find this evidence solid proof of this crime.

[10].       In Exhibit 3, the Second Defendant is caught illegally smuggling contraband into Vice City.

[11].       In Exhibit 10, the Second Defendants locker within the South Dade Warehouse is raided by the Police. Several illegal items were found, including a Desert Eagle and Kurz SMG.

[12].       The Second Defendant did not submit a plea, and was therefore automatically entered as a Not Guilty plea as per Judge Alexander Treblin's instructions.

William Leone/Elio Sinagra

13].       The Third Defendant is mentioned to be a member of the Leone Family. Evidence submitted by the prosecution in Exhibit 1 proves this, and we find the statement substantial due to the First Defendants position within the Organisation.

[14].        In Exhibit 3, the Third Defendant is caught illegally smuggling contraband into Vice City. We find the evidence submitted proves this beyond any reasonable doubt.

[15].        In Exhibit 3.1, the Third Defendant is recorded stashing the smuggled contraband inside the Leone Headquarters. We find the evidence submitted proves beyond any reasonable doubt that the building is connected to crimes committed by the Third Defendant (the owner) and the Leone Family, who all have access to said property proven in Exhibit 2.

[15.1].       In Exhibit 10, the Third Defendants locker within the South Dade Warehouse is raided by the Police. Several illegal items were found, including a Desert Eagle, marijuana seeds, and C4 explosive.

[15].        A submission by the Third Defendant was given to the Courts on the 30th of June, requesting a response by the Prosecution. The Prosecution submitted their response on the 1st July. We find the submission by the FBI, regarding the timeline, to be substantial. No plea was given by the Third Defendant, and was therefore automatically entered as a Not Guilty plea as per Judge Alexander Treblin's instructions.

[16].       The Third defendant is caught smuggling vehicles illegally at the crane in Vice Port. This evidence was submitted by the Prosecution on the 1st July, Exhibit 12

[17].       The Fourth Defendant is mentioned to be a member of the Leone Family. Evidence submitted by the prosecution in Exhibit 1 proves this, and we find the statement substantial due to the First Defendants position within the Organisation.

[18].        In Exhibit 3, the Fourth Defendant is caught illegally smuggling contraband into Vice City. We find the evidence submitted proves this beyond any reasonable doubt.

[19].       In Exhibit 10, the Fourth Defendants locker within the South Dade Warehouse is raided by the Police. An illegal item was found, a Desert Eagle.

Salvatore Fausto/Savitar_Leone

[20].       The Fifth Defendant is mentioned to be a member of the Leone Family. Evidence submitted by the prosecution in Exhibit 1 proves this, and we find the statement substantial due to the First Defendants position within the Organisation.

[21].        In Exhibit 8, the Fifth Defendant is arrested and interrogated by the FBI. During the interrogation, the Fifth Defendant establishes himself as a "Soldier" for Leone. Due to the Fifth Defendants position within the organisation, we find this statement substantial.

[22].        Further to exhibit 8, the Fifth Defendant stands charged for one count of Homicide, one count of Hit & Run, and one count of Obstructing Justice/Resisting Arrest.

I certify that the preceding twenty-two (22) numbered paragraphs are a true copy of the Reasons for Judgment herein of Judge Sir Klaus.

THE COURT ORDERS THAT:

[1].        That the first defendant: Franco Carruzzo/Franco_Leone/Lorenzo_Leone, be found guilty on two counts of Arms Trafficking and Smuggling of illegal contraband under by the Crimes (Further Offences) Ordinance 2017.

[2].        That the first defendant is to be convicted of leading an Organised Crime Family, conducting unlawful activities and highly organised crime at a very large level.

[3].        That the first defendant, be found guilty of money laundering.

[4].        Referring to case United States of Argonath vs. The Slasto Family, the defendant in this case was issued a sentence of 50 years for leading a criminal organsiation. The court believe that the first defendant should be sentenced to an aggregate term of imprisonment of 60 years, (60 minutes) to commence at the earliest date possible when the defendant is taken into custody.

[5].        Referring to case United States of Argonath vs. The Slasto Family, the defendant in this case was issued a fine of $400,000 for leading a criminal organsiation. With the prosectuions demands in mind, as well as a plea of guilty, the court orders that the first defendant be issued a monetary penalty of $500,000 ARD, to be stripped from the defendant's bank accounts and/or if the defendant cannot pay the sum, for the liquidation of any property, businesses, vehicles or other assets to cover such fine with the rest of the liquidation funds to go to the State.

[6].        That the second defendant: Mr Thomas Ricci/Tom_Anderson/Tom_Leone, be found guilty on two counts of possession of illegal weaponry prohibited by the Crimes (Further Offences) Ordinance 2017.

[7].        That the second defendant, be found guilty on one counts of illegally smuggling Automobiles.

[8].        That the second defendant, be found guilty of assisting in organised Crime.

[9].      That the second defendant is sentenced to an term of imprisonment of 35 years, (35 minutes) to commence at the earliest date possible when the defendant is taken into custody.

[10].      That the second defendant be issued a monetary penalty of $200,000 ARD, to be stripped from the defendant's bank accounts and/or if the defendant cannot pay the sum, for the liquidation of any property, businesses, vehicles or other assets to cover such fine with the rest of the liquidation funds to go to the State.
 
[11].      That the third defendant: Mr William Leone/Elio Sinagra, be found guilty on one count of Arms Trafficking and Smuggling of illegal contraband under by the Crimes (Further Offences) Ordinance 2017.

[17].      That the third defendant is sentenced to an term of imprisonment of 45 years, (45 minutes) to commence at the earliest date possible when the defendant is taken into custody.

[18].      That the third defendant be issued a monetary penalty of $350,000 ARD, to be stripped from the defendant's bank accounts and/or if the defendant cannot pay the sum, for the liquidation of any property, businesses, vehicles or other assets to cover such fine with the rest of the liquidation funds to go to the State.

[19].        That Property #84 at Downtown, if still under the possession of the Defendant, be removed from the Defendant’s possessions and held by the State. The State and its officials may determine what to do with the property after taking possession of the premises.

[20].      That the fourth defendant: Adrian "Parfait" Leone, be found guilty on one count of Arms Trafficking and Smuggling of illegal contraband under by the Crimes (Further Offences) Ordinance 2017.
