Apparently, the Public Ministry, is deciding that copying music and movies, etc from the internet(P2P) is legal.

If this goes trough, ACAPOR(The Association of  Audiovisual Commerce) will process the Portguese Government and denounce it to the European Comission.

This law(or absence of) is not applied if the pirated content is being used for commercial use.

For those who don't understand portuguese use google tradutor...

I see nothing wrong with piracy. Dont wanna waste tones of cash on real movies, or video games? Get a cheaper one, G!

There is a difference between downloading being legal and piracy being legal.
It is the same in the Netherlands.
Downloading in itself is not illegal, it is the usage of the downloaded content without a license that is.

So anyone is allowed to download all software, movies and music. However you can not run it, see it  or listen to it without having a license.

Then the creator of this content looses money, and the ability to create even better content. Piracy has a victim, many who do it are too blind to notice it or claim "oh they have enough money", well no shit thats because people use to pay, imagine if nobody did pay for the next Black Ops, you think they'd survive as a company? Nope. They'd go under, congratulations now thousands of people are unemployed, and roughly 0.80% of them are going to lead to suicide within the first 3 years. Kind of a rough reality, but truthful. Which is why I only do it to try something, then buy it if I honestly like it.

But that doesn't really make sense now does it? They can catch your burned DVD's or downloaded content, but they can't know if you seen it, or used it...

Exactly. So only if they can notice you in spreading it (unauthorized multiplication) or making money of it (for instance it is running in a business without any license) they will be able to act.
This limits the amounts of 'fast money lawsuits' that can be made, as well as give some protection to those who download things out of curiosity.

If no one would pay, you wouldn't have much to download.

I did say copy, eh?

If the makers of the game/movie/software or whatever would gain no money from their work, how many do you think would do spend their time doing it for free? Especially, for example, huge games like the GTA-series that cost a lot of money and man-hours to be made.

Try to think beyond your own life.
