Honorable judge, on the 28th of April 2021, [DU]Orochi was pulled over by PIG Jerry Swindle for driving on the wrong side of the road. PIG Swindle decided give a fine of $1,000 ARD to Orochi for reckless driving, but it was never paid. [Exhibit A]

Article 4: A person shall drive on the right-hand side of the road at all times unless directed by a law enforcement official. Violation of this article is liable to a fine of min. $1000.

The "prosecution" represented by Jerry Swindle is not authorized to represent the United States, and as indicated in his summons to the defendant, clearly labels himself as a "Prosecutor in the name of the United States of Argonath", which he is not. Subsequent to that, Mr. Swindle has been arrested for impersonation of a state official per a court-approved warrant and has been charged with the offence, among other criminal acts. The only individuals authorized to represent the United States are the FBI Lead Prosecutor or other FBI personnel should the case be backed and sanctioned by the FBI High Command. The State of Florida is also only authorized to be represented by the Vice City Police Department's High Command, or other VCPD personnel if backed and sanctioned by the VCPD's High Command. As such, the United States hereby files for a mistrial. The United States does not wish to pursue the charges or this case and therefore declares this case null and void. This dude had the whole Mexico and Middle East in his warehouse locker and now comes here to say that an ARPD volunteer is not representing the state? The United States requests the courts to charge this individual with contempt of court, and perjury, as well as refer to two violations of the Constitution of which at least one should result in criminal charges as substantiated by the evidence. This random individual is not a part of this case in any way, shape or form. This individual should not be involved in this case. As per the following ordinance of the Vice City Criminal Law: Section 10: Crimes against Justice Article 3: Contempt of Court - A person who willfully disobeys the verbal or written order of court authority, disrespects the decorum of the court or otherwise infringes upon due process. (This charge can only be issued by a Judge) Furthermore, decorum is defined as behaviour in keeping with good taste and propriety. This individual has infringed on this court's due process, and the prosecution urges the courts to charge this individual with contempt of court for his disruption and slanderous comments. Furthermore, your honour, this individual has violated two civil rights per the constitution: A. Freedom of speech and press. There shall be no law that hinders, prohibits or discourages freedom of speech (unless it includes personally insulting or defaming someone) of any individual, or of the press. H. The right to remain innocent before being proven guilty in a court of law for indictable offences. Your honour, this individual has labelled the defendant of this unsanctioned case as a "filthy criminal". This is slanderous behaviour and is in violation of the defendant's right to remain innocent before being proven guilty. The evidence of this case also does not show the defendant to be any sort of criminal or threat to the state. Therefore, this should be considered a further violation of the right to freedom of speech. Lastly, your honour, this random individual has levelled allegations of the FBI Lead Prosecutor using narcotics. This is a totally unsubstantiated claim and therefore constitutes perjury as per the Vice City Criminal Code: Section 10: Crimes against Justice Article 7: Perjury, providing false information as part of an affidavit, testimony, court-ordered deposition, under oath before a judge or document with a statement signifying its authenticity under penalty of perjury. Your honour, this individual has provided false information under oath before a Judge to the court, alleging the FBI Lead Prosecutor has used any form of narcotics in a slanderous statement that derails this court's due process and proceedings. The prosecution urges the courts to charge this individual with contempt of court, a violation of the defendant's constitutional civil right to remain innocent until proven guilty in a court of law and perjury. I. Statement regarding attempted mistrial claim

Honorable court, as I am currently jailed by the FBI Director, Kowalski, and awaiting trial as of yesterday (August 12th 2022), I am waiting to see the court case I was told by him that would be handed in, after which, I would love to poke holes in the mistrial claim, since as far as I know, the Director's claim is invalid and false, unless asked to give out a statement by the judge/s.



II. Statement regarding the file for criminal charges handed in

Your honour, this individual has labelled the defendant of this unsanctioned case as a "filthy criminal". This is slanderous behaviour and is in violation of the defendant's right to remain innocent before being proven guilty. The evidence of this case also does not show the defendant to be any sort of criminal or threat to the state. Therefore, this should be considered a further violation of the right to freedom of speech.

Honorable court, as the one who handed in this court case, I would like to re-iterate, for the record, that the defendant in this case (Orochi) is indeed a criminal, considering there is proof he has committed crimes [Exhibit A].
And as a personal note to Director Kowalski; please make sure to defend the civilians, not the criminals.

FILE FOR CRIMINAL CHARGES The United States wishes to very clearly reiterate the right to remain innocent until proven guilty as per the Constitution. H. The right to remain innocent before being proven guilty in a court of law for indictable offences. To be proven guilty in a court of law is for the court to hand down a guilty verdict. No such verdict has been issued yet. It is also debatable as to whether a traffic offence constitutes a criminal, however, the United States will leave that to the courts to determine. However, the actions of the individual, defended by Mr. Swindle, as a result of referring to a defendant who has not been ruled guilty by a Judge for a criminal offence as of yet as a "filthy criminal", is therefore violating the right to remain innocent until proven guilty in a court of law. The United States once again urges the court to charge the unrelated individual with contempt of court, a violation of the defendant's constitutional civil right to remain innocent until proven guilty in a court of law and perjury. Lastly, the United States has filed for a mistrial as per the court-approved warrant against Mr. Swindle. If the claim were invalid and false, a warrant would not be court-approved for this charge. JUDGEMENT

[1].        The Court accepts the fact that Prosecutor Mr Jerry Swindle is not an official United States Attorney, nor District Attorney, and therefore is not authorized to represent the United States. For that reason, Mr Jerry Swindle has indeed impersonated a government official, and will be charged with one count of Perjury and also one count of Impersonation under the Vice City Criminal Law 2021 for the Impersonation of a government official as well as providing false information before a Judge.

[2].        This case will be concluded a a mistrial due to the actions of Prosecutor Mr Jerry Swindle, and all charges against the defendant will be dropped immediately. If Mr Jerry Swindle wants to open a Civil case against the defendant, he is able to do so.

[3].        The Court orders for this man to be removed from the Courts immediately! I will absolutely not have this Court House turned into some circus for clowns. The individual will charged for Contempt of Court under the Vice City Criminal Law 2021 for his disrespect to the the decorum of the court. The Court will disregard anything this individual has vulgarly spat from the Courtroom balcony.

Sentencing

[4].        The defendant is found not guilty of all charges against him.

[6].        The prosecutor is found guilty of one Count of Impersonation. Therefore, the prosecutor* is to be issued a monetary penalty of $25,000 ARD.

[7].        The prosecutor is found guilty of one Count of Perjury. Therefore, the prosecutor* is to be issued a monetary penalty of $45,000 ARD.

[8].        Mr Andrew Aky is found guilty of one Count of Contempt of Court . Therefore, is to be issued a monetary penalty of $45,000 ARD.

THE COURT ORDERS THAT:


[1].        That the case be declared as a Mistrial, due to the above ruling. 

[2].        All charges against the defendant be dropped immediately.

[3].        Mr Jerry Swindle to be convicted of the crimes for which he has been found guilty for.

[4].        Mr Andrew Aky to be convicted of the crimes for which he has been found guilty for.
