From:
Harzy Crozier,
Dukes/Broker, Liberty City

To:
State of Argonath, People's Court

Dear court, on the date of 09/03/2016 I was pulled over by an ARPD Officer known as Mark, and I was told to pay a fine of 75$ for speeding. I asked for a screen shot (an evidence to prove that I was speeding) but the officer refused saying that he does not need to give me an evidence.

Then he took out his ticket book and wrote me a fine of 75$ for speeding over the limits by 11km/h as he claims.

According to the Traffic Tickets And Fines, the penalty of "Speeding above the limit [1-30km/h]" is either a Warning or a Ticket of 50$. But then he decided to cut it down for 50$ after I asked about it.

Then he said that he was going to suspect me if I did not pay the fine, so I decided to pay the 50$.

My demands: 50$ for the unfair treatment of the officer.

Yours faithfully,
Harzy

No evidence no party. I never accepted your cash so there is nothing to give back. The evidence (Since when you can avoid to pay ticket fines if you don't have a screenshot of /speed ? And since when is it a must to show them? I don't take screenshots of every guy speeding, i don't need to.) was given in roleplay. You, Harzy, simply refused to pay the ticket fine and made me drive you till the PD where after a long discussion, during which you kept refusing to pay the ticket fine, you decided to finally pay it. I did let you go with a warning since i felt that making a big deal for 50$ was completely useless and pure bullshit from you.

My only demand is a public apologize from Harzy Cozier, i already had to get bitched by his nonsense excuses to avoid a simply a traffic fine.

ps: i would like to remind that noany evidence against me was posted, this case is pretty useless without that

best regards to temporary judge

Honorable judge,

First, I did not ask for a pay-back as Mr.Mark states above. That was just my demand.

Second, Mr.Mark refused to take the money via /trade, so I thought he meant to take the 50$ in an imaginary way. So that is clearly a misunderstanding.

Third, the part where you should provide a screen shot for the results of /speed ID. I said what I have about this in the main post, I will leave further information/reply to the honorable judge.

Out of topic: I had an internet cut while uploading the screen shot, got it fixed now and uploaded the screen shot.

My sincere regards,
Harzy.

So? 75$, you got it lowered to 50$ since you made me aware that you wouln't pay 75$ as it was not in the traffic fines regulations. You're making a court case, wasting time of court for 50 bucks? Could've simply talked with a LCPD high ranked officer to solve it.

Get over it.

Honorable judge,

I cancel my demand of 50$. I instead demand an apologize from Mr.Mark publicly at this court hall (topic).

My sincere regards,
Harzy.

Dear Mr Harzy and Mr Mark,

I will immediately tell you my judgment in this case, as this case is relatively simple.

First off, if there was a fine to be given for speeding 11km/h too fast, it would have been $50. Reference to the topicTraffic tickets and Fines in the City Hall section.

The officer, in this case Mark, had all the right to fine you. It seems that he initially asked $75 for, but after you pointed out it should be $50 he lowered it. His willingness to lower it to the right amount shows to me that he didn't mean to issue a fine that is too much. If he was was out to overcharge you, he would have issued a higher amount. This shows to me he did not purposely issued a fine that is too high.

An officer who sees a speeding person with a vehicular object has the right to fine this person with the right amount (referenced before in this topic). The officer that issues the fine is not obligated to show pictures (ingame screenshots) of the amount of speed that the person had. However if the officer does have it, he can proof that the person was indeed speeding. When the judge, me in this case, has a reasonable doubt to believe that the officer wrongly states the speed then he can declare the fine unlawful and the officer will have to pay the fine back. In this case I do not believe that he wrongly stated the speed (80 km/h + 11 km/h). Even though there is no proof of the speed he stated, I believe that he correctly stated the speed as there is no proof either from the sueing party to counter this.

In the topic Traffic tickets and Fines it states that the officer can suspect you if you do not pay the ticket. The officer in this case was simply right to threaten you with suspectation.

The first and most important rule is to be always friendly with the traffic offender. After you commanded the offender to pull over, you must explain exactly what their done wrong and eventually the price of the ticket/fine offender is obligated to pay. In case that their is refusing to do so, you must warn/explain the offender about the consequences - becoming a suspect and eventually getting arrested. If the offender is still refusing to pay you are fully authorized to suspect for the traffic violation their committed.

After the person got suspected, he/she has a right for investigation if there was no evading from police. In case that it is proven by investigation that the ticket fine is justified, the person is offered with two options. One option is to pay for the ticket fine + compensation for the investigation, where compensation is of the same amount as the fine itself. In case that the person does not want to pay for the total fine, he/she is to be sent to jail. If needed, further discussion should be continued with a member of LCPD Command Staff.

Also from your story and your evidence I cannot see any abuse from the officer, since the payment of $50 is correct and he had the right to threaten you with suspectation. Mark will need to start his own court case if he wants to demand an apology from Harzy Crozier, though the chances will be slim that he will succeed. Also I do not see any reason why Mark should apologise to you (Harzy) since he executed his job lawfully. I do however, expect professionalism from both parties. That means you will both behave like you should, law abiding.

Therefor I will dismiss this case, all the demands are dismissed.

This is my judgment, but I will give you both the opportunity (in one reply) to come with evidences/proof that my judgment should be otherwise.
