I. Opening Statement

On 22nd January, 2018, defendant John Gotti has been wanted by the police on the charges of homicide. Said defendant was reported to have been residing in Apartment 3C, Property 195, Vice Point, and the police have swarmed the area and initiated an arrest operation.

Police units on scene have witnessed the defendant John Gotti storing items in his property upon police arrival, and has later been arrested.
Based on this fact, the Vice City Police Department has reached out to the court of Vice City to provide a search and seize warrant against the mentioned property. The warrant was approved and the execution has taken place on 27th January, 2018.

Following illegal items were found in the property:
1) Desert Eagle - 35 ammunition
2) Kurz MP5 - 400 ammunition

Upon further investigation, the Vice City Police Department has determined that the owner of the property is not John Gotti, but another defendant, Stefan Soprano. As referenced in this loan contract, it is established that Defendant Stefan_Soprano has agreed to auction the property to Florida Microfinance Lmtd. on behalf of the defendant John Gotti in a loan contract as asurance of payment. As this situation has determined, the owner of the property has also shared keys with the defendant John Gotti.

Vice City Police Department, however, has no way to prove without reasonable doubt that the owner Stefan Soprano was aware of the illegal items being stored in his property. Therefore, the prosecution will not charge Stefan Soprano, but will demand that the owner revokes the defendant John Gotti's access to the property as soon as possible, and surrenders the storage for further inspection to asure that the property did not continue to be used as an accessory to a crime after the police operation has been executed.



II. Legal Reference

Section 5: Illegal Possession Offences
It is a criminal offence for any person to be in possession of:
   (a) an M60 Machine Gun and any relevant ammunition for such weapon, or
   (b) a Bulldog Shotgun and any relevant ammunition for such weapon, or
   (c) a device that can project fire or flames and any petrol, fuel or other thing used to project such fire or flame, or
   (d) a rocket propelled grenade launcher and any relevant ammunition for such weapon, or
   (e) an explosive grenade(s) or remotely controlled explosive grenade(s), or
   (f) a Desert Eagle and any relevant ammunition for such weapon, or
   (g) a Kurz SMG and any relevant ammunition for such weapon.
   (h) a traffickable quantity of gemstones, jewels, raw minerals or any other objects or items that are similar in nature and/or purpose.

Section 10: Strict Liability
All criminal offences within this ordinance are to be interpreted that of strict liability, meaning that intention or mens rea is not required to find a defendant guilty of an offence in this ordinance.

1. Posession of illegal weaponry..
2. Homicide

IV. Demands

1. Citizen John Gotti to be fined 70.000 ARD for posession of illegal weaponry and imprisoned for ten years (10 minutes) in the federal prison.
2. Citizen Stefan_Soprano to revoke defendant's John Gotti access to his property as soon as possible and to surrender any illegal items stored by the defendant after access is revoked.
3. Citizen John Gotti to be imprisoned for twenty years (20 minutes) in federal prison for homicide.

Vice City Police Department does not offer a settlement offer to the defendant.

COURT MINUTE

The defendant has up to one week to enter a plea or he will be automatically entered into a plea of not guilty and the case will proceed to trial.
