I. Opening Statement

On 11th March 2018, one of the VCPD officers was contacted by citizen [UFt]Hazard (known as Rey_Soprano at the time) via phone. The said subject has inquired whether the officer had any illegal weapons to sell. We've decided to place the officer undercover and send him off to sell a Kurz MP5 submachine gun, acquired from the SWAT locker for investigative purposes. Officer was issued a wire-tap device and sent off.

They met in property #104 that belongs to the subject, located in Little Havana. The officer's wire has recorded the conversation between the two. [UFt]Hazard has bought 2499 ammo of FN-FAL and 500 ammo of Kurz MP5 submachinegun. He has then stored the weapon in his property.

Based on the evidence, a search warrant has been issued against the subject that has been swiftly approved. On 25th March, the warrant has been executed.

[UFt]Hazard has not only been found in posession of several illegal items and explosives, but was also found in posession of 65.480 Argonath Dollars in his property, which is considered tax evasion.

These are the illegal items that we have found in the subjects property:

1) Desert Eagle - 350 units
2) Grenade - 1 unit
3) Kurz MP5 - 889

4) Evasion of Tax - 65.486 dollars of undeclared funds.



II. Legal Reference

1.

Section 5: Illegal Possession Offences
It is a criminal offence for any person to be in possession of:
   (a) an M60 Machine Gun and any relevant ammunition for such weapon, or
   (b) a Bulldog Shotgun and any relevant ammunition for such weapon, or
   (c) a device that can project fire or flames and any petrol, fuel or other thing used to project such fire or flame, or
   (d) a rocket propelled grenade launcher and any relevant ammunition for such weapon, or
   (e) an explosive grenade(s) or remotely controlled explosive grenade(s), or
   (f) a Desert Eagle and any relevant ammunition for such weapon, or
   (g) a Kurz SMG and any relevant ammunition for such weapon.
   (h) a traffickable quantity of gemstones, jewels, raw minerals or any other objects or items that are similar in nature and/or purpose.

Section 10: Strict Liability
All criminal offences within this ordinance are to be interpreted that of strict liability, meaning that intention or mens rea is not required to find a defendant guilty of an offence in this ordinance.

Section 7: Tax Evasion Offences
It is a criminal offence for any person or body corporate to:
   (a) store more than $50,000 ARD or the equivalent currency in a house, business, building, property or any other place.

Minimum Penalty per Count: $48,000 ARD and/or 5 years (5 minutes) imprisonment

III. Charges

1. Posession of illegal weaponry.
2. Posession of explosives.
3. Tax evasion

IV. Demands

1. Citizen [UFt]Hazard to be fined for 45.000 ARD for three counts (15.000 per count due to the nature of the crime) of illegal posession.
2. Citizen [UFt]Hazard to be fined the minimum penalty of 48.000 ARD for tax evasion.
3. Citizen [UFt]Hazard to pay 18.337 ARD of unpaid taxes to the government (according to the 28 percent tax rate as per 2018.03.25)
4. Citizen [UFt]Hazard to serve 20 years (20 minutes) of imprisonment.


Total Fine: 111.337 ARD
Total jailtime: 20 years

V. Settlement Offer

Vice City Police Department would like to offer the defendant a settlement offer. If the defendant

... pleads guilty.

we're willing to lower the total monetary demands to 100.000 ARD and a prison sentence of 15 years (15 minutes) for the crimes comitted.
