    UNITED STATES OF ARGONATH VS. THE GONZALES MAFIA

    I. Introduction

    Greetings to the United States Supreme Court,

    On April 14th of 2020, an initial investigation against the Gonzales Mafia was initiated based on suspicions of criminal operation. FBI Agents have kept this organized crime syndicate under surveillance for quite some time now and have looked further into the defendant's activities to determine the legitimacy of our suspicions.

    Unfortunately, in the process of our investigation, we found our suspicions to be valid. With that, the United States of Argonath is now prosecuting this mafia for several crimes against the Constitution of the State of Vice and its bylaws.




    II. Case Breakdown

    First of all, the Bureau has collected several instances of intelligence with state of the art surveillance equipment. The Gonzales Mafia were initially investigated for crimes that were unconfirmed, however, with the assistance of two clandestine informants, the FBI was able to obtain evidence of the members of the Gonzales Mafia illegally smuggling vehicles, and growing illegal narcotics. In the course of our investigation, we also found evidence of terrorism, attempted murder, assault, attempts to damage state property, illegal Ogra poaching, and conspiracy to commit first-degree murder, among several other serious charges.

    The Bureau tracked these illegal activities being committed by the defendants and successfully collected evidence of each crime.

    We were also able to identify every member of Gonzales here, which is reaffirmed by members in an article of evidence showing their agreement to the Gonzales Organization committing crime as an organized entity.



    DEFENDANT ONE: MARTINO GONZALES

    Martino Gonzales is the leader of this syndicate and therefore the first defendant.

    On the 21st of June, 2018, Martino Gonzales was sighted fishing Ogras at the black market by a civilian. This was also reported on the 911 emergency hotline by another civilian [1].

    In February of 2020, Senior Officer Kowalski of the VCPD (currently FBI Director) responded with ARPD Officer Ben Kluger to a terroristic threat in the city, having to defuse several incendiary devices, within various locations, some being government buildings. Eventually, Senior Officer Kowalski caught the terrorist, later confirmed to be Martino Gonzales, and brought him into custody. In an attempt to escape, the terrorist pulled a firearm, attempting to kill the Senior Officer and made a run for it. However, Senior Officer Kowalski caught him and charged him with all committed offences [2].

    Based on the gravity of the offences committed, and the repeated number of times Mr. Gonzales has found himself in trouble with the law, we are unwilling to offer a settlement to this defendant.



    DEFENDANT TWO: KOOL GONZALES (AKA KOOL KAT)

    On the 31st of May 2019, Miss Kool Kat was sighted illegally smuggling vehicles out of Vice City through a crane at Viceport [1].

    On the 22nd of June 2019, Kool Kat was arrested by FBI Director Klaus Meine on a Grand Theft Auto charge, and for dangerous driving. It was alleged by the defendant that she had rented the stolen vehicle from the Triads for $1,000. She was then charged and detained in a holding cell [2]. On the same day, Miss Kat was sighted talking about lost explosives, and her accomplice stated that he picked up her "pack". Ms. Kat then committed conspiracy to commit first-degree murder when she plotted to kill someone, who she described as a "noob". She states that the person's name is "1337" and proceeds to retrieve weapons from a mansion in Vice Point, Private Property #293. Mr. "1337" is then murdered by Ms. Kat's accomplice, ZeMa. Having plotted to kill Mr. 1337, and the association with her accomplice, she is guilty of conspiracy to commit first-degree murder, as well as the first-degree murder itself, regardless of the crime being committed by her accomplice [3].

    The next day, on the 23rd of June, Kool Kat was sighted by the FBI selling ogras at the black market [4].

    On the 9th of July 2019, after obtaining weapons from her property, Private Property #58, Starfish Island House, Miss Kat aided a group of criminals in the threatening, harassment and attempted assault against FBI Special Agent Templeton Peck [5]. Based on the evidence provided, the courts granted a search warrant on Private Property #58. Within the property, when searched on the 27th of July, 2019, federal agents and VCPD Officers found substantial quantities of illegal items, ranging from Molotov cocktails to grenades, to explosive charges, substantial amounts of money (more than allowed by law), and more [6].

    On the 24th of August 2019, a man known as "MirZA" was sighted stashing items while being actively pursued by law enforcement at Private Property #58, Starfish Island House [7]. The courts approved a search warrant, and the property in question was raided on the 7th of September. Inside, illegal items were once again found, however in smaller quantities than the previous raid. This is likely due to the people with access to the house having just begun to accumulate more items for their storage again, however, due to the short time gap between the previous raid and this one, fewer items were accumulated [8].

    On the 26th of January 2020, Defendant Three, Gorcee Gonzales, was sighted obtaining weapons from Private Property #58. The defendant then proceeded to murder a police officer using said weaponry. A search warrant was once again granted by the courts for the property. This time, another substantial amount of money was found, once again a higher quantity than allowed by law [9].

    On the 8th of February 2020, Kool Kat was sighted by Agent Kowalski assisting Defendant Three, Gorcee Gonzales, in the destruction of government property [10].

    On the 10th of May, 2020, Kool Kat was once again sighted by a C.I. illegally smuggling vehicles out of Vice City through the very same crane at Viceport [11].

    On the 23rd of May, 2020, Mr. Gorcee was caught smuggling a vehicle per a sting operation set up, with an informant offering for the Gonzales family to illegally smuggle together as an organized entity. Ms. Kool Kat and Mr. Gorcee both accept and seem to like the idea, Gorcee proceeding to smuggle a vehicle afterwards, with Kool Kat being fully aware of the criminal plans, making her an accessory [12].

    On November 24th 2020, Ms. Kat was sighted once again smuggling vehicles. She was promptly arrested and interrogated at Washington PD. She then proceeded to lie to the FBI, continuously alleging that she did not smuggle vehicles, despite being shown proof that she did. It was later revealed that her motive was to try and raise money for her sick friend, and was shown a degree of leniency by Director Klaus Meine. She was charged with vehicle smuggling and obstruction of justice, however, she was not detained for long [13].

    Based on the gravity of the offences committed, and the repeated number of times Ms. Kat has found herself in trouble with the law, having been prosecuted previously in the cases United States of Argonath vs. Kool Kat and United States of Argonath vs. The Slasto Family one in which Ms. Kat was listed as an active member of the Slasto crime family, we are unwilling to offer a settlement to this defendant.



    DEFENDANT THREE: GORCEE GONZALES (AKA GORCEE)

    On the 8th of February 2020, Gorcee Gonzales was sighted by Agent Kowalski engaging in the destruction of government property with the assistance of Defendant Two, Kool Gonzales [1].

    On the 23rd of May, 2020, Mr. Gorcee was caught smuggling a vehicle per a sting operation set up, with an informant offering for the Gonzales family to illegally smuggle together as an organized entity. Ms. Kool Kat and Mr. Gorcee both accept and seem to like the idea, Gorcee proceeding to smuggle a vehicle afterwards, with Kool Kat being fully aware of the criminal plans, making her an accessory [2].

    Due to Mr. Gonzales' lesser involvement in criminal activities with this group, we may be willing to negotiate a settlement.



    DEFENDANT FOUR: HUGO GONZALES

    On the 23rd of April 2020, Hugo Gonzales was seen growing marijuana on an island not far from Downtown [1]. He harvests his illegal crops and stashes them at the Hyman Condo in Downtown Vice City, one of the Gonzales Family's main properties and primary HQ. The Hyman Condo was subsequently raided by Special Agent Kowalski and former Agent Rhyan Buchnan [2].

    On the 10th of May 2020, Hugo Gonzales participated in a smuggling voyage and stored the proceeds of his smuggling voyage at the Spand Express Warehouse [3]. This warehouse was later raided by Director Kowalski, in which four remote detonation grenades were found [4].

    On the 13th of May 2020, Hugo Gonzales was sighted by a C.I. stashing Molotov cocktails at Private Property #182, Emerald Square, Vice Point [5]. This resulted in a search warrant being granted by the courts, however, upon execution, the property was found to have been cleared out.

    On the 21st of August 2020, Hugo Gonzales was caught giving a C.I. a marijuana seed from his storage unit at the Spand Express Warehouse [6]. This warehouse was later raided by Director Klaus, Special Agent Templeton Peck and VCPD Chief Andrew Aky, where large quantities of illegal items were found [7].

    Greetings.

    I, Martino Gonzales, has arrived to address the case the United States of Argonath has against me. I would like to say a few things beforehand: I am quite short-tempered, as some people have noted. I also seem to have some kind of speech impediment; This, combined with the fact that I am still not very fluent in English, means you will have to put up with my Shatneresque... pauses, and my occasional swearing.

    I would like to start off by being completely transparent about what has happened in the past. I am a Cuban immigrant that arrived in 1980, during the Mariel Boatlift. The Cuban government has offered insufficient help to me, a former soldier of the Fuerzas Armadas Revolucionarias. Discontent with the government, I came to America to seek the American dream. Or so I thought.

    After around six years running errands for a few street criminals, I decided to start my own "gang" (in the definition of "organized crime", I did not work as an electrician). While this syndicate never achieved any notable... achievements nor a large enough reputation in the underworld to be taken seriously, it was, in hindsight, detrimental to Vice City's status quo. Not that it mattered, really, considering how crime was rampant at the time. But still, another reason to keep people scared.

    This crime organization recently ceased operations - around mid 2020, if I recall correctly. I have voluntarily closed it down. The exact reasons are... difficult to say in one sitting. But one of the reasons was that I have found myself sick and tired of everything - the killings, the drug-fueled rages, the internal power struggles.

    Next up, I would like to talk about my terrorism charges.

    During these times, I had been in contact with several international crime syndicates. I will not clarify on which - that's YOUR job to find them, not mine, that's why I pay my taxes.... Apologies. I embarked on a 6-month "business trip" throughout Europe and Asia. During a trip to the United Kingdom, I had the chance to visit an anarcho-syndicalist commune, an autonomous collective. After spending a week, I acquired consciousness: Supreme executive power derives from a mandate from the masses, not from some... preposterous electoral college! You can't expect to wield supreme executive power just 'cause some red or blue tart voted for you!

    Unfortunately, that happened to be the case here in the United States of Argonath.

    Disillusioned with the fact that Argonath is just another country that attempts to exert power for the elites by using the violence inherent in the system to repress the mass, I decided to use my resources to commit to an event which became known as the Mildly Troubling Sunday terrorist attacks of January 12th, 2020.

    Multiple explosive devices in Vice City - namely the ones at the City Hall, the nearly-finished-but-not-quite construction site, and at the El Banco Corrupto Grande were defused, but some landmarks like the Rump Tower, the Freedom Town and a public restroom were attacked. This would explain the 2020 recession, where Rump Organization stocks fell by 9%. Unexplainably though was the El Banco Corrupto Grande's stock which gradually fell 8% after seven days. Apparently - and this is unconfirmed - a person or persons has infiltrated the Vice City building and proceeded to offload half of the money in the vault to a secluded location, while the other half was discovered to have been burned. Daily Securicar trips would prove that the results of this attack, bad as it may be, was quickly patched up.

    Why? Why??? You want to know why? Because I was disgusted of how everything is done here - through greased palms, through politically motivated plots, through violence. Ma Dong of China has said "Politics is war without bloodshed". I believe in Vice City, politics is synonymous with bloodshed. Corruption, through various ways and means, is the core of Vice City. Money always has been the foundation that this society is founded upon.

    It is impossible for a human, no matter how moral, carefree or ignorant can stay aligned with justice in this town.

    While I plead guilty to the charges pressed against me, I believe that even criminals and compassionate, law-abiding citizens would agree with my views. That in Vice City, the struggle for a true American dream is as futile as a nuclear war. That in Vice City, the politicians seek to tackle the problem but not the source. That in Vice City, violence and drugs are stronger than the Argonath dollar.

    I have no trust in this tribunal to take into consideration the various reasons that plunged me into a world of crime and chaos so that they will give me a lighter sentence. I do not ask for anything from them. But to the people that are... figuratively listening to this, I believe you will agree with me. For I pray and beseech a fairer world.

    God's will, I proclaim that even if my life is to be taken away, the Lord himself shall recognize me as his son.

    RESPONSE TO DEFENDANT ONE:

    The United States wishes to point out that the country runs on democratic principles. There isn't violence used for any sort of mass suppression of the population by the authorities, nor is there any sort of censorship in place.

    We wish to point out that freedom of speech, free exercise of groups, petitioning the government and assembling peacefully are constitutional rights that no legislation may overturn or hinder.

        There shall be no law respecting the establishment of a religion, prohibiting the free exercise of a group,
        or abridging freedom of speech or of the press other than personal insults. There shall be no law restricting
        citizens' right to assemble peacefully, or petition the government. However, if the safety of other
        individuals is compromised, such assemblies and organizations are to be considered illegal.

    Therefore, it is simply not possible for the government to have repressed anyone. Your claims that corruption is the core of Vice City are false. Regardless of ignorance and even encouragement of corruption by past law enforcement, there is put simply no excuse to undertake the actions you did. Breaking the law in response to someone breaking the law will never produce justice, ever. That said, in the wake of recent events, the Federal Bureau of Investigation has cracked down hard on corruption and any breaches of the constitution or state criminal legislation.

    Your acts of terrorism were based on a skewed extremist view of the United States. Your actions weren't selfless, but selfish. You jeopardized city infrastructure, innocent lives, and last, but not least, condemned and attacked the democratic principles on which this country was founded.

    Your claims that remaining aligned with justice in Vice City is impossible are untrue and beyond disgraceful. You have condemned various competent and excellent law enforcers, implying they will later become involved in crime, or engage in corruption. Your claims are a disgrace to the hard work of these law enforcers to serve and protect the city.

    The United States urges the courts to show no leniency towards this defendant for his unspeakable actions and disgraceful comments, for undermining the credibility of the state and the federal government, as well as his attempts to undermine national security, on top of his complete disregard for innocent human lives as evident by his terroristic actions, to which we add his attempts to try and convince law-abiding citizens to align with his skewed, distorted and extremist views of the United States, possibly an act of treason in an attempt to breach national security through his actions and "justification" of said actions.
