As far as I know you can see weapons even if they're not taken out once.

Here is the answer on all your questions.

1. It shows all weapons they are carrying, regardless of whether they are put away or not. It is bannable because that gives you a visual advantage over other players.
2. That is your fault for installing the mod. It has been clearly stated in the forums several times that the use of mods are at your own risk, and any mods which give you an advantage will be disallowed. The admins are trying to give you a chance to fix it since your intentions are obviously not to cause problems. Don't take advantage of their assistance.

As far as I know you can see weapons even if they're not taken out once.

See: TinkyWinky, FrancisBriggs, =AV=Denzel. Full armors, probably armed with 9999 amount of weapons. Still I cant see their guns because they haven't took them out once.

It would be seriously a dumb thing to say if it gives us an advantage as all it does is just show what weapons they have holstered after taking them out..

They probably have M4/Combat/Ak-47 etc. It comes past your shoulder so you can probably see it with ease without any involvation from where he's facing. SMG/Deagle, it is holstered on your leg, those are pretty easy to see, doesn't matter where he's facing.
