I. Opening Statement

Honorable judge, over the past month, I have been leading an investigation against Mister [Triad]KL, now known as [Triad]Kenneth, regarding his groups infamous harpooning business.

The operation started on the 3rd of March, when I spotted Kenneth, near the ogra market in Downtown, and after asking him what he is doing, he admits harpooning ogras.
As he is being arrested, a frisking comes with the results of 11,000 ARD, which came from selling ogras he harpooned and 10 harpoon ammo, which he has been using to hunt the ogras. After being jailed, he is asked if he also has been selling the ogras, to which he replied positively, proving the 11,000 ARD on his persons are from selling the ogras.

On the 30th of March, he is caught in the act of harpooning ogras around the Stadium in Downtown. He is immediately told to disembark his boat nearby, which he complies to. He is taken to WBPD for interrogation, a frisk found 91 harpoon shots, some pump-action shotgun, 2 ogras he hunted and 19,000 ARD from selling ogras on his persons. He acknowledges his crime of harpooning, and after being asked if he hunts ogras frequently, he says no, and is then reminded of his past arrests over harpooning, one of which is shown above.
He admits on his intention to sell the 2 remaining ogras on his persons, after which he acknowledges his crimes once more, and is jailed.

On the 2nd of March, shortly after his last interrogation, he is asked to show up at DTPD for further interrogation, to which he accepts and shows up.
I explain to him I have a few questions to him about his recent hefty bids in the Vice City Auction House, like the toolshop in NPM, which he didn't win, but shortly after it ended, he bought the property from the winner; I ask him if the money he bought the property with is from harpooning, to which he replies "mostly from".
I then ask him what other properties he bought with harpooning money, to which he replies that the money used for other properties he bought are also mostly from harpooning.
I ask him what properties exactly he is speaking of, and he explains to me the property he personally owns, is property #72, the Vice Point Villa.
He is asked if he shares the money he gets from hunting ogras with his group, the Triads, and he confirms the speculation, saying "we shared together". After being questioned if most of the Triads is from harpooning, to which he explains "not exactly". He says "most of the money i earned was from harpooning", I ask him how much money he currently holds in his bank account, to which he answers 300,000 ARD.
I ask where most of the money earned from ogra hunting goes to, and he replies "properties and businesses". After being asked what other properties were bought with the money, apart from the ones he mentioned earlier in the interrogation, he is not sure, but gives me a list of properties owned by the Triads group: Vice Point Apartment #71, Vice Point Villa #72, Vice Point House #229, Vice Point Apartment #319, Vice Point Pizza Shop #74, Tarbrush Cafe #81, Tooled Up #171, Vice Point Hotel #188, Spand Express #215, Burger shot #269 and Uniqlo Clothes #305. All these properties have a total base price of 3,650,000 ARD, and that's excluding the Infernus Kenneth said they own, which adds another 220,000 ARD in combined property value and the 300,000 ARD in his bank account, resulting in a whopping 4,270,000 ARD total.

On the day of 30th, I just so happen to get evidence on Kenneth having and selling illegal items in his Vice Point Villa #72, which granted VCPD a raid warrant, executed on 14th April, and proved us that he was in possession of multiple illegal items; 4 weed, 16 weed seeds, and 20 explosive charges, proving further that even more of Kenneth's money is ill-gotten.

In conclusion, we want to fine Kenneth of the money gained from all of his illegal acts, and since most of the money he gains is shared with the Triads, we are requesting the properties mentioned above to be taken from them, in order to make up for the cash Kenneth does not have in his bank account anymore, and the fines can be paid properly.

    The Ogra is a protected class of marine wildlife. As such, hunting it is illegal.

Section 5: Illegal Possession Offences
It is a criminal offence for any person to be in possession of:
   (a) an M60 Machine Gun and any relevant ammunition for such weapon, or
   (b) a Bulldog Shotgun and any relevant ammunition for such weapon, or
   (c) a device that can project fire or flames and any petrol, fuel or other thing used to project such fire or flame, or
   (d) a rocket propelled grenade launcher and any relevant ammunition for such weapon, or
   (e) an explosive grenade(s) or remotely controlled explosive grenade(s), or
   (f) a Desert Eagle and any relevant ammunition for such weapon, or
   (g) a Kurz SMG and any relevant ammunition for such weapon.
   (h) a traffickable quantity of gemstones, jewels, raw minerals or any other objects or items that are similar in nature and/or purpose.

III. Charges

1. Harpooning ogras with the intention to sell.
2. Possession of Explosives.
3. Possession of Narcotics.
4. Distribution of illegal items.

IV. Demands

1. Citizen [Triad]Kenneth to be fined 2,300,000 ARD for several counts of hunting and selling ogras.
2. Citizen Kenneth to be fined 75.000 ARD for three counts (25,000 per count due to the nature of the crime) of illegal posession.
3. Citizen Kenneth to be fined 100,000 ARD for two counts (50,000 per count due to the nature of the crime) of distribution of illegal items
4. Citizen Kenneth to be jailed for 30 years (30 minutes in-game).
5. The Properties mentioned above be stripped of their ownership.

V. Settlement Offer

Vice City Police Department is willing to lower its demands to:

1. Fine of 1,800,000 ARD in total.
2. The properties mentioned above be stripped of their ownership, excluding properties #269, #229, #319.
3. Imprisonment for 15 years (15 minutes in-game).

Officer,why should I paid so much just for hunting Ogras.The demand made by you will cause a large loss to the Triads and make us thoroughly bankrupt.All our long-term efforts finally come to nothing but punishment.It is completely unacceptable to us.I admitted that most money were from harpooning but it doesn't mean that we were fishing all the time.Sometimes we also did some legal jobs.Unlike other criminal organizations in the city,we didn't raid and kill people to get money.
Actually everyday I would see that lots of people including the innocent died from various criminal events.But still a lot of criminals evaded and didn't get punished.Why all you care is not life of civilians but just Ogras?I really don't understand your point of view.As well I have to say that Ogra,this kind of marine wildlife,breed fast and they absolutely won't die out.I am certain about this.

My client Mr. Kenneth Law a.k.a [Triad]KL/Kenneth is not only physically and mentally disturbed by the allegations put forward by the Prosecution but also that it is inflicting direct damage to my client's well maintained reputation. I request the court to register these details.

I would like to paddle up by justifying that my client comes from Chinese origin i.e he can not interpret English very well. That means, he might have had conceived the questions/statements put forward by Deputy Chief during the interrogation incorrectly.


Moving further towards the evidences and allegations put forward by the Prosecution.

I.

As he is being arrested, a frisking comes with the results of 11,000 ARD, which came from selling ogras he harpooned and 10 harpoon ammo, which he has been using to hunt the ogras. After being jailed, he is asked if he also has been selling the ogras, to which he replied positively, proving the 11,000 ARD on his persons are from selling the ogras.

The first recording is the evidence that my client had been harpooning ogra but its not clear that the 13.000ARD carried by him came from selling ogras.

Let me justify, by rewinding the recording again,
"So, you were harpooning and selling" Deputy Chief
"Yes" Kenneth

Yes, it proves that my client was harpooning ogras, but as he was going back to sell them, Deputy Chief stopped him. My client meant that he had been going to sell those, he never mentioned that the cash he had been carrying came from selling the endangered species.

As the Deputy Chief mentioned in the third recording, my client runs a tools shop, the cash came from the same medium not by any illegal/unfair means of income.

I would ask the prosecution to put forward an evidence which clearly proves that the cash carried by my client directly came from selling ogras.

He is taken to WBPD for interrogation, a frisk found 91 harpoon shots, some pump-action shotgun, 2 ogras he hunted and 19,000 ARD from selling ogras on his persons. He acknowledges his crime of harpooning, and after being asked if he hunts ogras frequently, he says no, and is then reminded of his past arrests over harpooning, one of which is shown above.

Same as Evidence I., the second recording doesn't clarify that the cash i.e 19.000ARD came from harpooning.

He admits on his intention to sell the 2 remaining ogras on his persons, after which he acknowledges his crimes once more, and is jailed.

Unfortunately, my client claims that he was going to sell those ogras, but as it can be observed, he was already put behind bars for his wrongdoings.

I would, once again, like to ask the Prosecution to provide clear evidences.

III.

I explain to him I have a few questions to him about his recent hefty bids in the Vice City Auction House, like the toolshop in NPM, which he didn't win, but shortly after it ended, he bought the property from the winner; I ask him if the money he bought the property with is from harpooning, to which he replies "mostly from".

No doubt my client bought out the business from the winner which happens to be, me. Several months ago when I asked him "Where did this money came from", before handing over him the shop. He replied "Mostly from.... truckering". As I mentioned earlier, my client fails to produce English words instantly.

Something identical can be observed in the third recording, where he had failed to speak the word "Trucking" just after "Mostly from". It seems like the speed of Deputy Chief slashed through the interpreting power of my client. Another question was put up before he could answer. He actually wanted to express that the money came from trucking which is, in fact, a legal job.

He is asked if he shares the money he gets from hunting ogras with his group, the Triads, and he confirms the speculation, saying "we shared together". After being questioned if most of the Triads is from harpooning, to which he explains "not exactly". He says "most of the money i earned was from harpooning", I ask him how much money he currently holds in his bank account, to which he answers 300,000 ARD.

Rephrashing the recording again, my client never claimed that he shared his money to other members of the Triad foundation. They are no more than friends and relatives and have zero business ties.

My client replies with "not exactly" to express the above but, unfortunately, Deputy Chief misconcieve his words.

Although, my client claims that the roots of "his" property i.e #72, Vice Point Villa has been set up by harpooning.

IV.

I ask where most of the money earned from ogra hunting goes to, and he replies "properties and businesses". After being asked what other properties were bought with the money, apart from the ones he mentioned earlier in the interrogation, he is not sure, but gives me a list of properties owned by the Triads group: Vice Point Apartment #71, Vice Point Villa #72, Vice Point House #229, Vice Point Apartment #319, Vice Point Pizza Shop #74, Tarbrush Cafe #81, Tooled Up #171, Vice Point Hotel #188, Spand Express #215, Burger shot #269 and Uniqlo Clothes #305. All these properties have a total base price of 3,650,000 ARD, and that's excluding the Infernus Kenneth said they own, which adds another 220,000 ARD in combined property value and the 300,000 ARD in his bank account, resulting in a whopping 4,270,000 ARD total.

As I mentioned before, my client has no ties to other Triad Foundation members. Which means money, that was earned through harpooning, was only and spent on Kenneth's belongings i.e the Vice Point Villa. All other properties have no direct relation from this trial.

Also, my client never claimed that his car, Model Infernus, was built up from any illegal means of income.

Moving on, the combination of all the recordings does not prove that the sum of money, in Kenneth's bank, account came from any kind of unfair means.

I would like to clarify that 4.270.000ARD is an impractical amount of money which can not come from harpooning.

As of the last year's census, there were only about some ten thousands of ogras in the Oceans of Vice. Even if all of them are sold, it can't produce such a big amount of money regarding their current market value. If that money comes from ogras, I doubt if they are really endangered. You would need to catch over 80.000 ogras in order to gain that much money. And we know its not possible.

I would like to point out Deputy Chief's incomplete investigation at this point. There are no evidences proving the mentioned properties belong to the Triad Foundation, and also "the infernus" which we don't know if it's even there in the city or not, no number plates, IDs, RCs not even a color. This puts a question mark to the activeness of so called  Deputy Chief".

V.

On the day of 30th, I just so happen to get evidence on Kenneth having and selling illegal items in his Vice Point Villa #72, which granted VCPD a raid warrant, executed on 14th April, and proved us that he was in possession of multiple illegal items; 4 weed, 16 weed seeds, and 20 explosive charges, proving further that even more of Kenneth's money is ill-gotten.

My client claims himself guilty of storing illegal weapons in his property. Although there is no evidence proving he was willing to sell them.

The last evidence does not prove anything, as it is a broken link of a board over ArgoNet.


I would also like to set up a reference from case United States of Argonath vs Ibrahim13 where the defendant paid only 40.000ARD for breaking similiar laws and acts.

Conclusion and Demands

As my client is shameful of his acts and the damage he did to the nature is ready to :

• Pay a fine of sum 75.000ARD for the possession of illegal items.
• Serve 10 years (15 minutes in game) for his wrongdoings.

, I want the courthouse to acknowledge that :

• My client has recently been shifted to a mental asylum due to the depression caused by the allegations.
• My client had been donating large sums of money to poors and now barely has enough for himself.

and hence demands :

• The 1st demand of Prosecution to be lowered to be lowered down to 200.000ARD
• The third demand to be abrupted due to lack of evidence.
• The properties stated in the above hearing to remain untouched except Property #72
• Strict action to be taken against Deputy Chief Danigold for putting on claims on the behalf of incomplete investigation.
• My client to be given some more time to pay the damage, as of his mental condition.
• A sum of 10.000ARD from the prosecution for putting up false/not-proved allegations.
• Obligations/Allegations put against my client which fail to prove anything to be dropped immediately.

JUDGEMENT

[1].        By criminal summons and information filed on the 14th of April 2018,¹ Mr Kenneth Law(the 'Defendant') stands charged with one counts of possession of illegal weaponry under the Crimes (Further Offences) Ordinance 2017. The defendant also stands charged for 2 counts of possession of illegal substances under the Crimes (Further Offences) Ordinance 2017. The defendant is also charged for distribution of illegal these illegal substances.

[2].        Mr Kenneth Law has been charged for multiple counts of Poaching, illegal hunting of wild animals, in this case the indigenous Ogra of Vice City. In Exhibit 1, the evidence provided by the prosecution is proof that the defendant was illegally hunting Ogras by harpooning them. We also find Exhibit 2 compelling evidence of the defendant was poaching Ogras and selling them for a total $19,000 ARD. 

[3].        The Prosecution held an interrogation of the defendant on 2nd April 2018. We find the evidence provided proves further beyond reasonable doubt that the defendant committed acts of Poaching. The defendant openly confesses to have sold up to $300,000 ARD worth of dead Ogra's. We however do not find the evidence proves Kenneth Law's involvement with the Triad, neither do we see see compelling proof that he has communicated or shared money with other Triad members.

[3.1].        The Prosecution has further submitted Exhibit 5, showcasing the defendant attempting to distribute illegal substances.

The Criminal Law

[4].        It is enough to say that the defendant has breached the law in being in possession of the illegal items confiscated.

[5].        I find the evidence presented by the prosecution proves clear enough that the defendant has Poached Ogras on multiple occasions.

Sentencing

[6].        We find the monetary fine proposed: $ 1,800,000 ARD, will be decreased to $638,000 based on the evidence provided. $319,000 is confirmed by evidence, but evidence is enough to prove that the defendant has been Poaching excessively and therefore this value is multiplied by 2. The term of imprisonment proposed of 30 years is decreased to 20 years, based on the fact the defendant placed a guilty plea early in proceedings.

[7].        With respect to the private properties mentioned by the prosecution, the Court will only grant that property #72, Vice Point, be removed from the Defendant’s possession, if it is not in the Defendant’s possession then no action against the property is to be taken. The reason for such is that the property has or was become a known premises for illegal activity and the reputation of such a property should be changed.

[8].        The defendant is found guilty of attempted distribution of illegal substances. Although the evidence provided does not prove beyond reasonable doubt that the defendant committed acts of distribution, the intent is clearly shown. Therefore, the defendant is to be issued a monetary penalty of $80,000 ARD.

[9].        The defendant is found guilty of one count of illegal possession of C4 explosives. Therefore, the defendant is to be issued a monetary penalty of $50,000 ARD.

[10].        The defendant is found guilty of two counts of illegal possession of narcotics. Therefore, the defendant is to be issued a monetary penalty of $30,000 ARD based on the amount confiscated by the police.

11].        The defendants overall charge to be decreased by 15% due to a guilty plea given early in proceedings.

[12].        As such the final sentence that I hand down for the defendant is for him to be fined $623,100 ARD, and for the defendant to serve a term of imprisonment of 20 years (20 minutes). I find no need to take into considerations good behavior or parole as these are systems not developed in this jurisdiction.

I certify that the preceding twelve (12) numbered paragraphs are a true copy of the Reasons for Judgment herein of the Judge Sir Klaus.

THE COURT ORDERS THAT:

[1].        That the defendant is to be convicted of the crimes for which he plead guilty to.

[2].        That the defendant is sentenced to an aggregate term of imprisonment of 20 years, (20 minutes) to commence at the earliest date possible when the defendant is taken into custody.

[3].        That the defendant be issued a monetary penalty of $623,100 ARD, to be stripped from the defendant's bank accounts and/or if the defendant cannot pay the sum, for the liquidation of any property, businesses, vehicles or other assets to cover such fine with the rest of the liquidation funds to go to the State.

[4].        That Property #72 at Vice Point, if still under the possession of the Defendant, be removed from the Defendant’s possessions and held by the State. The State and its officials may determine what to do with the property after taking possession of the premises.
