1. Case Introduction

On 27th May, 2018, Federal Bureau of Investigation has launched an investigation to locate, identify and prosecute a new rumoured criminal entity operating in the streets of Vice City. Upon deeper efforts, this group was soon uncovered to be named as the Leone Family.

The Federal Bureau of Investigation has placed an undercover operative inside the organisation in order to retrieve more sufficient evidence of the group and its operations. This undercover operation has revealed that the group has been involved in numerous of illegal activities as a particular entity and should therefore be prosecuted collectively.

The asset introduced into the organisation has been equipped with a discrete wire-tap recording device, as well as a state of the art government funded discrete body camera that is able to take snapshots remotely. With the help of the mentioned devices, the asset has fed information to the Bureau for almost a month.


2. Case Breakdown

To begin with, the Bureau has acquired knowledge of the identities of people involved in the criminal organisation, as shown by Exhibit 1. These people, at the time of identification, originally were known as:
• Lorenzo Leone
• Tom Leone
• William Leone
• Adrian Leone
• Savitar Leone
• Jazz Leone
• Salvatore Fausto
Several individuals have changed their names for several instances during the processing of this case. All of them have been idenfitied

Please note, that it is explicitly stated that Leone is a united and organised entity, proving that it has acted collectively as one entity, meaning that everyone involved were aware of the areas of operation and operations of the Leone Family.

However, during the time period of 05.06 to 06.06, the Bureau was informed by the asset in the group that the individuals mentioned above have changed their identities. With the help of the information provided by the asset, as well as state registry records, the Bureau was able to discover their new identities, which are provided in Exhibit 6. To avoid further confusion, new identities of these individuals will be used in further prosecution.

We were able to gather evidence of the main headquarters of the group being used for illegal purposes, such as storing items retrieved from the smuggle operation while wanted by the police, as seen in Exhibit 3

Additionally, our asset has held the South Dade Warehouse for the Leone's to use during the operation. As the operation has concluded, the asset has consented the search of the warehouse. Several known members of the Leone were found to be in posession of illegal items, as can be seen in exhibit 10. Unfortunately, it seems that all the illegal items that were stored in Downtown Skyscraper have been moved as per the search warrant execution operation on 18th June.


3. Charges and Demands

• Franco Carruzzo/Franco_Leone/Lorenzo_Leone, named as the leader of the group, has been actively organizing and encouraging criminal acts as the head of the Leone Family. What is more, we can prove without any doubt that Lorenzo Leone has taken part in two smuggling operations, causing significant damage to state finances. We have also retrieved evidence of money laundering committed by the subject, as evident in Exhibit 9.
The Bureau refers to Exhibits 1, 3, 8, 9 to back up the charges.
We demand that Lorenzo Leone is fined 1.000.000 ARD for organization of criminal activities and two counts of smuggling illegal goods in and outside the state and money-laundering and imprisoned for life (70 minutes) in Federal Prison. Additionally, we demand that the bank account of the defendant is frozen due to being used as means of money laundering.

• Elio Sinagra, formerly known as William Leone, has also taken part in a smuggling operation, as proven by Exhibit No. 3. Additionally, William Leone has allowed use of and used their property #84, Downtown Skyscraper, as an accessory of comitting criminals acts, such as storage of illegal weapons and narcotics retrieved via the smuggling operations of the group. This is proven by Exhibits 3 and 7.
Therefore, Elio Sinagra is being charged with Smuggling of Illegal Weapons, Narcotics and Explosives . Additionally, Elio Sinagra's storage in South Dade Warehouse has been found to contain 10 amounts of Narcotic Weed and 5 units of explosives, 375 units of Desert Eagle. Therefore, we are also charging the individual with illegal posession.
We demand that the individual is fined 900.000 ARD for their crimes and imprisoned for 50 years (50 minutes) in federal prison.

• Adrian Leone has taken part in an illegal smuggling operation comitted by the group, as evident in the exhibit No. 3. Therefore, we are charging this individual with Smuggling of Illegal Weapons, Narcotics and Explosives inside and outside the state of Vice City, and Illegal Posession of Desert Eagle handgun, 450 units and demand a fine of 450.000 ARD and imprisonment of 45 years (45 minutes) in a Federal Prison.

• Thomas Ricci/Tom_Anderson/Tom_Leone has taken part in an illegal smuggling operation comitted by the group, as evident in the exhibit No. 3, and comitted the crime of illegal posession of 400 units of Desert Eagle and 531 units of Kurz SMG (exhibit 10). Additionally, Tom Leone has contributed to the blackmarket by smuggling stolen vehicles inside and outside the state, as seen in Exhibit 5. For this reason, we demand a fine of 700.000 ARD and imprisonment of 50 years (50 minutes) in a Federal Prison.

• Salvatore Fausto/Savitar_Leone has committed an act of murder on 06.06.2018 and has been pursued by police, refusing to surrender. After a long pursuit, the subject has crashed his car and was apprehended by the FBI. Suspect was interrogated according to the law, during which he admitted of his crime and affiliation to Leone. The FBI demands that Salvatore Fausto is fined 100.000 ARD for the act of murder and imprisoned for 20 years (20 minutes) in Federal Prison.

• The Bureau demands that Property #84, Downtown Skyscraper, is not sold, handed over or otherwise has its ownership changed until the court adresses the following demand:
    •• The Bureau demands that Property #84, Downtown Skyscraper, is seized from the defendant Elio Sinagra and is auctioned to compensate the damages caused by its use as an accessory to a crime, contributing to the circulation of illegal weaponry, narcotics and explosives in the state. We also demand that the defendant is prohibitted from acquiring this property during the auction.
       ••• The Bureau demands that Elio Sinagra is issued additional charges of contempt of court and obstruction of justice if this demand is not met.

• That the Leone Family is shut down as a criminal entity.

As stated in the above statement that I committed a murder but there is no evidence of me admitting the murder instead it has been made clear to FBI special Agent Gabrial Adams that it was a complete self-defense and even the Chief did not question about it so I think my stance is clear.
The only offence I did was that I tried to evade the cops but this does not make it a "Hit and Run" case. Afterwards i surrendered to the police and gave my statement to Agent Gabrial Adams. For that particular offense I had been given punishment accordingly and as seen in the exhibit no.8, I think it is clear that I didn't commit the murder on purpose and all it was just a self-defense.
I feel the evidence is incompetent to my stance and the charges implemented on me must be dropped as their has been no "Law" which states self-defense as an state offence.
lastly, I will maintain my affiliation with the Leone Family and as stated by FBI special agent Gabrial Adams that Leone is a criminal entity, well everyone has his own views and their is no evidence of me involved in the atrocities with the family. So I demand the prosecution to drop the charges against me.

RESPONSE TO DEFENDANT SALVATORE FAUSTO

Your Honor,

As the defendant has mentioned himself, there is no legal reference in the constitution or other legal documentation of the court that would appropriately address the matter of self-defence in general, therefore, murder cannot be classified as anything other than murder, regardless by what motivations it was driven.
Under such circumstances, the common practice by the law enforcement of Vice City is that those who claim self defence are released from detention and have charges dropped if they stop and surrender after such act or if/when no-longer endangered, and if they are able to prove claims of self defence. The defendant, however, has refused to surrender and continued evading the FBI and VCPD after several warnings to stop their vehicle and surrender, therefore making themselves guilty of the crime by evasion.

Furthermore, having been detained/jailed in a holding cell for the crime is not definitive and does warrant a court case if the crime is serious enough. The mentioned claim of having been "punished for the crime" holds no legal value.

An act of murder is an atrocity by itself, Mr. Fausto.



The Prosecution requests that the defence choose a legal representative to represent the Leone Family, as is a case in group prosecution, insetad of posting individual defences. The Bureau has no resources nor time to respond to individual defences of all five men being prosecuted, and will no longer respond to any further individual defences.

The Leone Family has been proven to be an entity and is being prosecuted as such, therefore, it must vote on a common legal representative.
The Prosecution will maintain this notion unless demanded otherwise by court. The prosecution also demands that any individual defences are not considered by the court.

On 06.06.2018, after I delivered a truck loaded stock to Meison Weinfall, I was heading back to VCPA. After I parked the truck at its place, I went to my cabin(vcpa)  and packed for home, it was nearly 11 PM. As soon as I came out of the building, a man with a mask and a gun was standing right in front of me. I knew his intentions that he wanted to rob me. We both were alone on that road sight that night which he fully took advantage of, as he came close me to search my pocket for any valuables, i knocked him down by kicking on his balls. As a matter of fact, we truckers are given a standered shotgun to confront rogues or robbers on our way to deliver the stock (only given to the truckers who go out of city during night). I took my shotgun out from the truck and aimed at the robber but he refused to stay down and infact he tried to take out his gun, after several warnings, he still would confront me, I pulled the trigger.
This was the first time I had ever shot a guy, i was in a state of constriction. The overstrain of my mind made me panic and penetrated my senses. The voices of sirens made me scared and all this lead to trepidation. In that mental condition, I took decisions out of my consciousness.

You tell me, what will you do when you are in such a mental state and you are just 22 killing a first  person in your life. Therefore I would like the Court of Justice to look over this point and then decide.

We are rather puzzled and confused by the defendants display of hipocricy. Our agents have discovered that on the same day this defendant has posted their defence, they have, once again, without any show of remorse for the crimes committed against the state and the people of Vice City, stolen a vehicle and sold them to the blackmarket dealers, in other words, comitting yet another count of vehicle smuggling. The said act has been recorded by CCTV footage. We hope that the court considers this information when judging the concience and credibility of Mr. Sinagra.

To respond to their direct defence, however, we counter-argue that our evidence is rock solid. The exhibits provided clearly show that the group has taken part in illegal contraband trafficking operation, and has afterwards used the property of the defendant to store the items acquired, as established by the timeline by use of the camera timestamps (/time). We are well aware that legal weaponry or items are always handed out as rewards for such contribution to the act, therefore, the charges are rather clear and well founded.

In other words, the timeline provided establishes that the defendant stores the items in the property moments AFTER taking part in an illegal smuggling operation, which by itself makes the property accessory to a crime. The nature of the items handed out after such operations are no secret to anyone either.

An act of taking the life of another person is called murder, regardless under what motives it was driven. As per the case breakdown, the defendant clearly states that he has taken the life of another person under the motive of "self defence". However, self defence has to be proven, something which the defendant did not have means to prove, which means that the charge of homicide stays as the charge of homicide, as per the legal system of Vice City (otherwise, similar practice is also exercised in the States of San Andreas and Liberty City for court reference).

Additionally, instead of surrendering immediately to the law and request for an investigation to be pardoned for self defence, the defendant has actively evaded the police, and, as seen in the evidence, even refused to stop for a Federal Agent. The pursuit has continued until the defendant has flipped his car and had nowhere to run, being threatened to be shot if he does. What this means in the legal system of Vice City and the law enforcement practice in all three states of Argonath, including San Andreas and Liberty City, is that the defendants crime becomes valid by the fact of evasion. In other words - if you evade the police after being charged with a crime, regardless of what that initial crime could have been, you are automatically guilty for that crime. This is also reinforced by the VCPD public service announcement published in 2017.

You are indeed correct in regards to your observations.
Vice City Police Department's previous amendments of the Procedures and Regulations stated that exceptions to the right of investigation are applied to those who have made effort to evade the police force or otherwise resist arrest, shot upon the police force or are wanted for murder. Murder was to be always treated as a guilty verdict by the VCPD and therefore citizens wanted for murder were not to be investigated.

However, upon the introduction of the Law Enforcement Ordinance, an amendment to the Vice City Police Department Procedures and Regulations has been made, removing this exception in order to be in accordance with the Vice City Constitution and the Law Enforcement Ordinance. This change was made on 7th January, 2018 among with amendment of the rest of VCPD Protocols.

Therefore, an officer who would refuse an investigation against a suspect that is wanted for murder would be found guilty of breach of procedures and regulations if they were to be filed a complaint against. However, I would highly advice against such action, as it seems that such actions of the officer were due to no proper anouncement being made on such changes, therefore, the officer might have been acting in accordance with the Procedures and Regulations before the amendment.

We are sorry for the inconvenience this might have caused, and we will make sure to inform all of our officers with a request to post a read and understood notice that Murder charge is no longer an automatic guilty verdict. Thank you for bringing this issue to our attention.

I'd like to get clarifications for all citizens of Vice City as to what scenarios are a suspect allowed an investigation under the constitution until the 2nd of February, how VCPD will handle said investigations, and will they change (if at all) after the ordinance is in effect.

Nothing will really change in the way investigations are being handled, as the Procedures conflicting with the Law Enforcement Ordinance were already amended.
At this current moment, as well as after 2nd February, in order to be eligible for an investigation a suspect has to:
1) Stop and Surrender immediately after issued a suspection.

The Police Force will refuse an investigation if:
1) The suspect has opened fire against the police force
2) The suspect has made effort to evade the police force or otherwise attempted to resist arrest, which is a crime on its own.

Attempting to evade the police force is a crime on its own and makes whatever reason you were suspected for previously valid ((exceptions are made for cases of abuse by new players when they ignore your /sur's and therefore evading is the only way you might avoid dying)).

As established by the constitution of the State of Vice City:
Act XVIII
    Defense of one's property or belongings is authorized. Any destruction or damage intentionally inflicted upon
    private property is of criminal resort. However, an individual who uses unreasonable force while defending their
    property may be arrested for the use of unreasonable force.

        Subsection I
        Interpretation and investigation of unreasonable force is open to investigating officers.

... which means that the VCPD, according to the Subsection I above, are allowed to establish the practice previously mentioned when concluding whether the suspect is guilty of murder or may be cleared for self defence. As the practice pointed out by the VCPD PSA has not changed, the defendant is guilty of murder as due to evasion his crime becomes valid under whatever circumstance.

Dear Judge;
This is the first time I face a court case against me, yet I see it unfair to be demanded a fine of about 450,000 ARD for taking part in one illegal act and storing its reward, while I saw other defendants in other cases, who made terrible things and caused the loss of many lives of animals or human, that were only fined amount of money that doesn't overcome 200,000 ARD
In addition to that, as I mentioned above this is the first time I make an illegal act hence I learnt my lessons and regret of my acts and what proves that is that how I changed and became a lawful cititzen and sometimes I volunteer to help cops at doing their jobs so peace can reign in streets.
so I request judges to lower my fine as well as my jail time and due to my poor english and limited understanding of how court system work, I hereby want to hire a lawyer to defend me, but I didn't find any one to do that job so if it is possible I request the court to hire a lawyer for me and I will pay for him.
