UNITED STATES OF ARGONATH VS. [VU_T]EAZY

I. Introduction

Greetings to the Argonath Federal Court,

On July 1st of 2019, an initial investigation against Mr. Eazy, based on suspected criminal operation, was initiated. FBI Agents have kept this individual under surveillance for quite some time now and have looked further into the defendant's activities to determine the legitimacy of our suspicions.

Unfortunately, in the process of our investigation, we found our suspicions to be valid. With that, the United States of Argonath is now prosecuting this individual for several crimes against the Constitution of the State of Vice and its bylaws.




II. Case Breakdown

First of all, the Bureau has collected several instances of intelligence with state of the art surveillance equipment. The initial crimes Mr. Eazy was investigated for by the FBI were illegally smuggling vehicles on a large scale, and harpooning Ogras in large quantities. In the course of our investigation, we also found Mr. Eazy guilty of resisting arrest, obstruction of justice, possession of illegal firearms and incendiary devices, tax evasion and money laundering.

We were then tracking these illegal activities being committed by the defendant, and although unfortunate, successfully collected evidence proving the alleged initial crimes.

Between May and July of 2019, we were able to track 11 counts of vehicle smuggling by the defendant. The exact vehicles are unknown, however, it is confirmed that the defendant smuggles them regularly [1]. FBI Director Klaus was also able to catch the defendant laundering his illicit money gained from one of these counts of vehicle smuggling by depositing it through the El Banco Corrupto Grande Institute of Banking [2]. Director Klaus later interrogated this individual. During the interrogation, the defendant confesses to having obtained $500,000 through means of vehicle smuggling and illegal ogra hunting. Mr. Klaus later detained the suspect, but despite that, Exhibit 2 displays that the defendant had returned to the crimes of which he was detained for later on within the evidence log's timeframe [3].

On the 21st of July, 2019, the defendant was found to be selling Ogras at the black market. He was suspected and then resisted arrest, eventually escaping law enforcement. This reinforces our previous statement, that the defendant returned to the crimes he was punished for later on. He was truthful about one thing during the interrogation, his desire to make money [4]. Later that day, a warrant was approved by the Argonath Federal Court to raid Private Property #114, Ghetto Shack, Little Haiti, belonging to the defendant at the time of the raid. Four illegal items, a Bulldog Shotgun, Kurz MP5, explosive compositions, and a Desert Eagle were found within the property. In the process of our investigation, we also found the defendant to be evading taxes by storing $294,043 in cash within his property [5]. This is an astonishingly substantial amount of money over the legal limit of $50,000, shocking law enforcers involved in the raid operation. This grand-scale evasion of tax has caused the United States lost revenue due to Mr. Eazy breaking the law in order to get away from paying his fair share of tax. The United States of Argonath believe that this should not go unpunished and should be considered a major scale crime, evading over $75,000 of tax.

On the 22nd of July, 2019, the defendant was arrested and charged twice on this same day for illegally hunting Ogras. 7 ogras were found in his possession during the first arrest by the arresting officer, Chief of Police (then Senior Officer) Andrew Aky with the State Police and again with 7 ogras a few hours later by FBI Special Agent (then Agent) Templeton Peck.

The amount of ogra he has been caught poaching, combined with the substantial evidence we have, showing a grand total of fifteen counts of ogra fishing, proves beyond any possible doubt that Mr. Eazy does not care about the fact that he is breaking the law, shows no remorse whatsoever, nor any recognition or understanding of the impact his actions are having on endangered wildlife within the state, but only seems to care about money and personal gain, even if it requires malicious activity to obtain. This is further reinforced from his lies and attempting to frame an innocent group of people. Through lying to Agent Peck about his affiliations and then attempting to fabricate a fake identity, the defendant committed two acts of Obstruction of Justice by attempting to prevent a law enforcer from carrying out their tasks of enforcing the law. With the second count, he attempted to frame, and deflect some of the accountability onto a group he refers to as the Triads. His lies, were they to have been acted upon, could have had seriously unwarranted repercussions upon innocent individuals, which we, the United States of Argonath, deem to be an additional count of fraud. To clarify, we believe that fraud is defined as wrongful or criminal deception intended to result in financial or personal gain. Mr. EazY attempted to extort personal gain by deflecting the blame and accountability on an innocent group of people, in the hopes we would perhaps go easier on him due to him providing testimony against the people he alleged to work for. We believe that this sort of criminal conduct is simply unacceptable and should be punished very severely [6].

The defendant was also caught by former VCPD Cadet Astol Fo illegally smuggling vehicles through a crane and a cargo freighter at Viceport [7]. This was the last recorded crime from the defendant since August of 2019. The suspect then went under the radar, likely in an attempt to throw law enforcement off his back, suspecting that he may have been under surveillance. However, in February of 2020, he was caught by Agent Kowalski, again partaking in illegal vehicle trafficking, confirming that his ties to the criminal underworld were still present, and still strong [8]. Agent Kowalski saw this occur for the first time in February, but then saw it happen again, showing that Mr. Eazy has clearly not learned from his mistakes, but is only interested in criminal profit, regardless of how malicious they may be.

Another search warrant was granted by the Federal Court for the defendant's second residence: Private Property #324, Vice Point Apartment, Vice Point. We found four packs of explosive composition there, totaling to five counts of possession of illegal items/firearms [9]. This goes to show that regardless of the previous search warrant and the heat that the defendant came under from law enforcement, he is still interested in collecting dangerous, illegal weaponry, very likely with extreme criminal motive. Finding explosive charges within the property after searching his previous one only goes to show that Mr. Eazy is a hardened criminal who is willing to take very dangerous risks in his wake, just for the sake of illegal profit, possibly resulting from activities of a terroristic nature, based on the explosives found, along with the rest of the illegal weaponry.

IV. Charges and Demands

The United States of Argonath, represented by the Federal Bureau of Investigation disseminates the following charges and monetary penalties demanded:

1.) Eighteen (18) counts of vehicle smuggling:

As referenced by the case United States of Argonath vs. Kool Kat and the number of times we have caught the defendant smuggling vehicles, we demand a monetary penalty of $175,000 ARD.

2.) Fifteen (15) counts of illegal ogra poaching // $125,000 ARD

As referenced by the case United States of Argonath vs. Kool Kat and the number of times we have caught the defendant illegally poaching Ogras, we demand a monetary penalty of $125,000 ARD.

3.) Five (5) counts of Possession of Illegal Weaponry // $130,000 ARD

As referenced by the cases United States of Argonath vs. Kool Kat and United States of Argonath vs. [NAR]Spartain, as well as the number of illegal items we have caught the defendant in possession of, we demand a monetary penalty of $130,000 ARD.

4.) Two (2) counts of Obstruction of Justice // $90,000 ARD

5.) One (1) count of Fraud // $90,000 ARD

6.) One (1) count of Tax Evasion // $245,000 ARD

Based on the large amount of money found within the property, as well as the lost governmental revenue, with added extra to serve as part of the total fine, we demand a monetary penalty of $245,000 ARD.

We demand that the defendant is fined with a monetary penalty of a total of $855,000‬ ARD for the crimes committed against the state. We demand that should the defendant be unable to pay the amount, that his assets be liquidized and sold to pay the penalty. The state also demands that the defendant be issued the following prison sentencing:

1.) Eighteen counts of vehicle smuggling - as per the case by the United States of Argonath against the Slasto Family, we demand 20 years (20 minutes) of imprisonment.
2.) Fifteen counts of illegal ogra hunting - as per the cases by the United States of Argonath against Kool Kat and [Triad]Kenneth, we demand 20 years (20 minutes) of imprisonment.
3.) Five counts of Possession of Illegal Weaponry - as per the case by the United States of Argonath against [NAR]Spartain and Kool Kat, we demand 15 years (15 minutes) of imprisonment.
4.) Two counts of Obstruction of Justice - we demand 10 years (10 minutes) of imprisonment.

All the demands made by the United States are per the Constitution, and the respectively breached ordinances. We, the United States, believe that every crime should result in criminal repercussions, especially considering the gravity of the offences and the repetitive criminal acts committed by the defendant. It is the defendant's own fault for bringing himself into the situation he currently finds himself in by his own criminal actions and the fact he knowingly committed said offences.

Nothing is infinite as the defendant has seemingly tried to claim. By metal, we would assume he is speaking of the vehicles he has smuggled. This is illegal per the Further Crimes Ordinance:

Within Evidence Display 3, it is clearly stated by the defendant during interrogation that he has made a minimum of $500,000 ARD, and this interrogation took place in 2019. In the time afterwards, it can only be assumed that he has made more from the criminal evidence presented afterwards, including the substantial amount of money found within the defendant's property, being used to evade tax. We believe this makes the property in question an accessory to tax evasion.

We, the FBI, remain adamant that the defendant faces all charges presented in our case.

The United States of Argonath is unable to provide evidence of full continuity for this count.

If the current evidence is considered invalid and cannot prove the charges beyond any reasonable doubt to the courts, the prosecution is willing to drop the fraud and obstruction of justice charges.

However, the United States remains adamant that the defendant faces the remaining ogra poaching charges presented, and we believe that the evidence proving it is conclusive.

JUDGEMENT

[1].        By criminal summons and indictment filed on the 21st of September 2020, Mr. Eazy (the ‘Defendant’), is charged with various charges. I will discuss the evidence in relation to the defendant.

[2].        The defendant has been charged for 15 counts of Poaching, illegal hunting of wild animals, in this case the indigenous Ogra of Vice City. In Exhibit 4, the evidence provided by the prosecution is proof that the defendant was caught in possession of dead Ogras. Exhibit 4 also includes an incomplete recording of the arrest process and interrogation.

[3].        The defendant has been charged for 18 counts of smuggling vehicles out of Vice City. In Exhibits 1, 2, 7 and 8, the evidence provided by the prosecution is proof that the defendant was caught several times smuggling vehicles. Exhibits 7 and 8 name 2 different LEOs who have submitted evidence to the prosecution.

[4].        The defendant has been charged for an accumulative 9 charges of several other crimes; Possession of illegal weaponry, fraud, obstruction of justice and tax evasion. The evidence provided for these charges are exhibits 3, 5, 6, and 9.


Defence Submissions

[5].        The defence does not plead guilty, and brings into question a failure in evidence 5, which will be mentioned again soon.

Failures In Some Of The Evidence

Ground One: Failure in evidence 1 and 2

[6].        The prosecution submitted 2 exhibits of the same instance of vehicle smuggling, from different angles and counted them as 2 different instances. Therefore, 1 charge of vehicle smuggling will be removed.

Ground Two: Failure in evidence 3 and 6

[7].        The prosecution submitted incomplete interrogations in exhibits 3 and 6, and failed to provide full, uncut and proper recordings of these interrogations, and asked to drop the charges linked to these exhibits.

Ground Three: Failure in evidence 5 and 9

[8].        The prosecution submitted evidence showcasing the results of raids on properties #114 and #324. The evidence however does not include any proof that the defendant was the owner of the properties at the time of the raid. Therefore, charges linked to these evidence are dropped.


Sentencing

[9].      In addressing sentencing, the defendant is found to be GUILTY of 17 counts of vehicle smuggling. The court accordingly penalizes the defendant a fine of $165,000 ARD, taking into account the demands of the prosecution, and sentences the defendant to be imprisoned for 20 years (20 minutes).

[10].      The defendant is found to be GUILTY of 15 counts of Poaching. The court accordingly penalizes the defendant a fine of $125,000 ARD, taking into account the demands of the prosecution, and sentences the defendant to be imprisoned for 20 years (20 minutes).

[11].      The prosecution wished to drop the charges for fraud and obstruction of justice, therefore they are dropped.

[12].      The defendant is found to be NOT GUILTY of all charges of tax evasion, and possession of illegal weaponry, in reference to paragraph 8 (Failure in evidence 5 and 9)

THE COURT ORDERS THAT:

[1].        That the defendant is to be convicted of the crimes for which he plead guilty to.

[1].        That the defendant is to be convicted of the crimes for which he was found guilty of.

[2].        That the defendant be issued a monetary penalty of $290,000 ARD, to be stripped from the defendant's bank accounts and/or if the defendant cannot pay the sum, for the liquidation of any property, businesses, vehicles or other assets to cover such fine.

[4].      That the defendant is sentenced to an aggregate term of imprisonment of 40 years (40 minutes), to commence at the earliest date possible when the defendant is taken into custody.
